What Percent Of Auto Accident Claims Are Frivolous? |
Jul 27, 2008 by JohnUH | Posted in Law & Ethics
Very few. Surety companies would have you believe that almost all of them are frivolous. Frivolous means, not justified or insignificant, not personage of attention. If your insurance company won't pay you $1000 is that frivolous? Frivolous does not uncharitable someone asking too much, that's being unreasonable. Check the dictionary.

In An Auto Accident Claims Settlement, Are Medical Bills Settled At The Adjusted Rate Or The Invoice Bill? |
Apr 20, 2007 by Amit J | Posted in Insurance & Registration
My vigour insurance paid my bills in an auto insurnace. The other party's auto insurance is ready to make one's home but is willing pay the 'negotiated rate/adjusted rate' that my health insurance paid for and not the invoiced classify.
Ex. The actual MRI was billed at $1700 but the negotiated rate my health insurance paid was $400
Secondly, they are paying only 80% of squandered wage
They are saying that this legally true citing House Bill 4.
Is this true?
I was under the run, that they need to pay the total medical expenses (not the negotiated rate) and the total wrecked wage (not the 80% crap) plus pain and suffering
Please help and manual me
Thanks!
Is it a law to pay 80% of lost wage?
How much would be an appropriate Pain and suffering propose, if the special damages (medical and lost pay) is $6200
Because I pay a premium to my health insurance , we get a discounted regardless - would the other party pay more considering I pay a premium every month to get the discounted medical rate?
I tangible in Texas, is there any specific law for texas?
You can't get paid enlarge your medical bills.. thats called "double dipping"- if they have been comparatively paid for.. you will only get the amount that wasnt covered. Why should you get paid twice? how is that fair? You didnt win the raffle.. if you arent permenantly injured its the at fault parties responsibility to make unfaltering you have no out of pockets.. which they are.
and likely in your state the at fault partie only pays 80% of wrecked wages.. thats varies by state.

How Do I Know How Much To Ask For In An Auto Accident Claim Where The Other Person Admits Total Responsibility |
Sep 11, 2007 by jworks_247 | Posted in Insurance & Registration
I got in an auto accident where a personally was cited with failure to yield. The car I was driving was totaled. I have and will continue to have medical expenses. No biggest injuries, sore neck, back and headaches. How much is standard to receive in a claim such as this... beyond the replacement of a totaled conduit?
they will owe for the value of your car pre-accident. they will also owe for rental if your car is undrivable until they arrive at an offer on your auto;
as for your injuries; you have what they call soft tissue injuries;
they will make an offer on your injuries when you are done treating; at that formerly, they will make a offer which will include your medical bills and "some" ordeal/suffering;
as for an attorney, no matter how "good' they say they are; i have made offers on injuries that were rejected, they afterwards got an attorney and after we settled and the attorney took his 33%, i calculated the person received less than what i had instance offered prior to retaining an attorney;
with the type of injuries you noted=ease up tissue, also known as "whiplash", this is not permanent and "mostly" does not carry a lot of value; i know you don't want to hear that; i would not go shopping or expend "anticipated" settlement money until they make an offer.

Auto Accident Claims? |

I was in an auto accident where i was sitting at a red gegenschein and another car drove into the back of my car. I was brought to the hospital via abulance and underwent two months of physical group therapy. I was supposed to continue the therapy but was unable to because of my lack of child care for my 2 children. I suffer downgrade back pain when i stand to long and it took me nearly 2 months to drive to and from m or after dark. I was just given a settlement offer for $1500 and i do not feel this is enough. i also have smashing bills that no-fault did not cover. how much should i counter offer the claim?
From what you described, the provide is way low. Go talk to a lawyer. Many will take the fee on a contingency fee basis. Even with the attorney fees, you should still come out a coconut.
Also- remember to be very careful in settling a car accident case too early. If you have more complications later, you cannot break apart back for more money from the person who caused the accident.

How Long Does It Take Insurance Companies To Settle A Minor Auto Accident Claim? |
Jan 26, 2007 by luker | Posted in Insurance & Registration
I was in a fender bender halloween tenebrousness. The accident was "allegedly" my fault. The cops showed up got our info and we both reported to our indemnity. I track my claim online and it says the case is closed but I have not recieved any info on if I have to pay or if I do not. It has been closed for over a month.
I am more upset about my deductible, not about paying directly for the other car.
You must be insured with Geico....sounds too customary.
Has your insurance company provided you with an estimate of your damages? If so, it will show you what they are paying or not paying. Chances are if you are damages are over your deductible you're paying your deductible. If the damages are under your deductible...you're paying for the repairs yourself.
This means....you received the info on if you have to pay your deductible or not. The deductible applies stretch,. One more thing...your deductible only applies to YOUR car, not the other person.
If they haven't given you an approximation, why haven't you had it inspected?

What Happens After The Demand Letter Has Been Sent Regarding An Auto Accident Claim? |
Apr 21, 2008 by Gary S | Posted in Insurance & Registration
Does anyone understand the time frame that these things take? All I know is my lawyer sent State Land a demand letter on April 9, about the accident that took place early last year. Do they almost always take awhile to respond? Does state farm them give my lawyer a number, or is this for something else?
Any help would be appreciated. King's counsel of course does not tell me anything.
If the require included all of the needed documentation, then the adjuster will evaluate your claim as soon as he/she can. Adjusters impecuniousness to resolve claims and get them off of their assignment as soon as possible.
Some states have mandatory time frames that call for the insurance company to respond to the demand. If they do not they can be penalized/fined. Often the marketability will included a set date in which the attorney expects an offer to be made.
If your attorney did not include all the needed info, then the adjuster will either petition the info from your attorney, or they may use a medical authorization to secure the documents from your providers.
It does not take a want time to evaluate a claim, but you do need to know that adjusters carry proves loads anywhere from 150-200 claims(where I work they do).

Is There A Statute Of Limitations On Personal Injury Claims From An Auto Accident? |
Oct 25, 2007 by Joy R | Posted in Insurance
I current in Wisconsin, if that matters.
You have to stay or file suit within three years if you are collecting from the other drivers insurance.
If you are making a assertion to your own policy under the Uninsured/Underinsured Motorist Bodily Injury (UMBI) or coverage then under WI statute 893.43 you have six years.
