What Are My Rights As To The Auto Insurance Claim Process?

My picture: 2003 Hyundai Santa Fe 4 cyl 40,700miles purchased:2/17/2007 for 11,000.00 put 5000.00 down
Wrecked 2/24/2007 deemed unconditional loss by insurance company full coverage policy. Received offer within one week for 8600.00 before paying deductible 500.00, I refused the present because because it is worth more than 8600.00. They told us they were only obligated to give us payoff amount(lie#1)
I obtained an independent appraiser per my game plan. The insurance company refused to talk to my appraiser and refused to hire one for their side(per their own policy). They told my appraiser they had to be licensed in Texas(lie#2)My appraiser is a national train. They told me the report my appraiser produced was not good because none of the vehicles compared to mine were in Texas. (Lie#3) I turned them into the Texas Unit of Insurance. The then told us they hired an appraiser and they would be contacting mine. That was almost 2wks ago, still nothing. Do I have a legal case?

As far as I grasp,insurance only has to pay what the book value of the car is. Doesn't matter how much you owe on it or how much you paid for it. This is the way it has always worked for me when I had accident harm.
Do an online value for your car on the Kelley blue book site,that should give you some idea if you are getting shafted.

Auto Insurance Claim Process, Texas?

Ok, We were at a ideal stop at a red light about to make a right hand turn when a lady hit is from behind. All it did was moment our bumper a little but we are about to take it to our dealership to see if there was any additional damage. It was the other driver's fault. We exchanged insurance dope and took pictures. No officer report was filled because the 911 agent said a office-holder is not needed unless someone is injured, the vehicle are not movable, or one of the parties is failing to care for information. None of these criteria was met so an officer was not sent to the scene.

My question is if we report this to our insurance throng to repair any damages, would this make our insurance premium go up?
Would we have to still pay our deductible for any repairs?
Or would the other driver be culpable for all or any payments for repairs?

This is our first accident / fender-bender and like I said the reparation doesn't look too bad, just a crack in the bumper and a bent up license print.
We have a 07 Toyota Yaris (still making payments) and our insurance is full coverage threw Nationwide. We red-hot in Texas.

I just would like to know how this process would work if we make a claim to our auto insurance company to try to get repairs. If we don't have to pay any "out of pouch" expenses then yes, we want it repaired. But me and my wife are not sure if our premium will go up or if we will have to pay our deductible for repairs even though it was not our blameworthy and we got hit from behind while at a complete stop.

The other driver's insurance following should take care of your repairs and a rental while your car is in the shop. Many companies have "deals" with good shops to do the repairs at the company's estimate; her company should tell you if that's the case; otherwise, they'll reckon the damage, cut a check to you, and let you go wherever you want for repairs. The rental should be billed direct to the throng, and you shouldn't be out of pocket for anything.

If the other company drags its feet, you can go through your collision with Nationwide, but you'll have to foot the decuctible. Nationwide will then try to amass from the other driver's insurance and should reimburse your deductible. You don't say who the other company is, so I can't say what to expect, but overall you should have little or no irritation other than some inconvenience.

Your rates should not go up, as this accident wasn't your fault.

Can I Move While An Auto Insurance Claim Is Processing?

I was in an catastrophe late July. It was not my fault and i was injured in the accident. I am still going for physical psychoanalysis.

I have been looking for a new job in another state, due to the accident it has come to a standstill.
I wanted to know if i can move to another maintain while the insurance claim is still processing. The other party has not yet come to a settlement.

Please can get some advice and help, it will really assist me.

Of no doubt you can move -- they can't restrict you're right to make your residence any place you see fit. It'll inconvenience you more than anyone else, since any hearings will take proper in the original jurisdiction.

Just make sure you notify all the parties intricate of your new address -- forgetting one might be one of those techicalities that prove to be fatal to your case.

How Quickly Are Auto Insurance Claims Processed?

Specifically when I wasn't the one at pick at and I am processing the claim through the other person's insurance. What is the time frame? thanks
I really want to take my car to the majority shop ASAP!! How long will I have to wait?


Heres a scarcely trick you can use. It has worked for me twice. Tell the other guys insurance company that you use the car for business, and until you get it rigged, you will be claiming "down time" The insurance company WILL NOT be too happy about having to pay you for down heretofore and will get things taken care of very quickly!

Whats The Process Of A Auto Insurance Claim?



1. Story the claim to insurer of both drivers
2. Claims reps investigate. Determine liability (who's at impugn)
3. Determine damages--can car be fixed? How much will it cost? Is a rental vehicle owed? if car can't be stuck what is its market value? etc...
4. was anybody injured? What exactly are the injuries? Was the accident despotic enough to cause injuries in the first place? What is the medical treatment? Was the treatment reasonable?

Now for info you can use. Call your adjuster. Be acquainted with your claim number when you do. If not, get the claim number and have it ready every time you call. If fault isn't determined or your car not yet fixed, call the adjuster perhaps every three days.

You have the well to:
1. Have a rental vehicle provided by the other party's insurer if the other party was at fault.
2. Prefer your own shop (however, often the insurer will guarantee the work of shops they recommend--it's a fable that insurane companies try to poor guidance you to crappy cheaper shops--they are mostly interested in shops who are not out to cheat them.)

For Liability (imperfection): Unless you are sure you are at fault, be prepared to give a very detailed description of what happened, including things like were headlights on, ponder over b reverse signals, brake lights, how far away from other car did you first see them, what did you do to avoid the accident, were there any witnesses THAT YOU CAN Relate (you would be surprised how many times people claim there were "lots of witnesses but none of them stopped". Why pick a fight when all you lack is your car fixed?)

If you are injured, see a MEDICAL DOCTOR first, not a chiropractor. You can see a chiro after the doctor, but people who run honestly to the chiro are often those trying to exaggerate their injury, and it looks suspicious. if someon is really injured, they see an MD and only then go for treatment from lesser experts such as chiropractors, physical therapists, accupuncturists.

Sample Auto Insurance Claim?

I am working on a conjure up on how an auto insurance claim is processed and I need to use a sample claim letter from the company. stating what happened in the fluke and how much of a loss there was...can anyone help find any website that I could get a fake one off of?? or anyone know where or how I can make a fake one?

how covet does it take to process an auto insurance claim?

I had a minor accident. the back tire of a car being towed came off going down the method and hit me and put a dent in my rear door. I got the guys insurance info and filed a claim the next day. A week passed and no dialogue, so i called the insur company, my claim was on file but nothing had been done yet. the insur company told me to get an evaluation and fax it too them which i did. another week has passed and still no word. I called and left a voice mail with the adjuster several times but can't get a call back. I would like to get this unchangeable asap. anyone have any insight? the estimate by the way was about $550 if that matters


Walk a comprehensive claim with your own insurance company. They'll take care of the damages far quicker than the other guy's company.

Processing Auto Insurance Claims . How To Get Into Handling Claims??

i have three years with an auto insurance assembly that processes auto insurance bills. i have two years in auto insurance billings. this mainly just processing the bills. i am active to the UK. is this enough experience to get in to handling claims/adjuster.??


It would favourite depend on the insurance company, and the actual position. The more well known insurers require adjusters(those handling bodily mischief claims, significant property damage, contractual claims etc.) require a four year college bit by bit. They generally do not require experience. The insurance company will train the adjuster.

If you do not qualify for an adjuster's status, you could be a Claims Service rep. Where I work, these folks handle first and third party auto claims. Some pat minor injury claims. After a few years at that position, most get promoted to the Claims Adjuster positions.

What Are My Rights On An Auto Insurance Claim? Please Help?

Where I abide (USVI) to own a vehicle you must transfer the title in front of a notary, get the vehicle inspected, then registered at DMV, then insured. I purchased a channel and transferred the title at end of business hours. Before the next day, an insured drunk driver totals out the parked channel and takes total responsibility. The insurance company tells me that the claim will have to be processed in the original owners name since it was never registered. After a droll claims process with countless fees and costs, the check is written in the original owners name who agrees in critique to sign it over to me. Now the insurance company says that I have to take the canceled title back to the DMV, get it in my name, then immediately cancel it on the spray. All of this will make the check less than what I have invested now. What all extra does the insurance company owe me (loss of use, rental, etc) since their typographical error has delayed the process over 3 weeeks?

recently, i had a very trifling fender bender by backing out a parking space and hitting a car behind me the damages was not inordinate, my car was not damages at all not even a nick are scratch on it but the other person car had some light scratches and slight dent at that area, i ask her as we got out i am callin police to come write up a police report, she begged me not to, so she ask for my name and phone enumerate only nothing else i felt so weird about that because from my experience u need a police report to even file a claim to ur insurance, but any way my call in was can u have ur auto insurance company fix ur car without formal police report? and this person have not contacted me since the car excident.. what now? its been a month..

So Mr. Reid wants to reduce this tax and is floating a new Medicare payroll tax surcharge as a substitute.

Until 1993 the Medicare tax was capped— the Societal Security tax still is capped at $106,800 this year—because Medicare was supposed to use like an insurance program. For example, the rich don't pay more for auto insurance than the poor do. But Democrats lifted the cap with their 1993 tax boost waxing, so the Medicare levy now amounts to a marginal rate tax on every new dollar of wage revenues. Mr. Reid's payroll surtax would sever the link between the tax paid over a lifetime and the medical benefits received, officially making Medicare an takings redistribution program.
