What's My Right In Car Accident Claims When The Accident Was Not My Fault?

I had a car accident last week, and is not my blemish as the other driver ran into me (he amitted it to the police). the car wasnt in a drivable condition as it has to be towed to the put back in people. my question is, as my car is only a month old, what's my right in relation the the claims etc with the car. To be honest I dont extraordinarily want the car to be fixed. thank you


Rules on this will alternate by state. Some states you can refuse to have it repaired if the damage exceeds a certain amount or piece of the value, or if it's under a certain age.

Here are some rights you'll have: They should pay for a rental vehicle while your is being repaired, or for a reasonable amount of prematurely for you to find a new vehicle if it gets totalled (for example, they should pay for a rental until the claim is settled, together with an additional week if it gets totalled). If you decide not to get a rental, they should reimburse you the costs associated with having to pay someone to urge you around, usually up to the amount a rental would cost per day.

If the vehicle is not in satisfactory condition for you when they finish working on it, you do not have to recognize it until you are satisfied with the repairs. They're supposed to make it as it was before it was damaged.


I certainly don't blame you for not unsatisfactory it repaired, you bought a new car and not a repaired one. I would tell them as much when dealing with them and tell them you want it replaced, not repaired. Since it is only a month old, they should in harmony up and pay you the full amount of the vehicle. Good luck with this, I hope you can get it replaced.


Before going through your carrier, I would weigh the options of having an attorney take trouble of it and leaving your insurance company out of it. I say this because I've seen people get taken advantage of by common through their carrier and tehy worked together with teh other company to save them money.

You have more leverage working with their transmitter since it was their fault and they'll want to avoid a lawsuit if at all possible. If you work with your carrier, it is not as peacefully to pursue legal action and you have less leverage.

Also, they will ask you questions in a recorded conversation disquieting to get you to say you have no injuries. The best answer to "do you have any injuries" or "do you have any signs of injuries from this accident" or any other call in like this is to say "not at this time" or "nothing that's apparent right now". This will slow them from saying you told them everything was OK and you weren't injured if it goes to court later on from injuries that may be brought up out from the accident later.

COULD YOU TELL ME WHO DO I COMPLAIN TO ABOUT A CLAIMS COMPANY WHO MESSED MY CAR ACCIDENT CLAIM?

i had a accident which wasn't my liability but it took over three years to sort my claim but the claims company used a dodgy wangle in which i could only accept a low offer my car was put into storage i had to pay to get it back and it st in my driveway for 2 years and it is still unrepairable


What do you carry by they used a "dodgy engineer"? Why did they need to take on an expert? It should not take three years to settle a claim, unless this was a third party claim with very problematical liability. There is a reason why the insurance company acted/handled your requirement the way they did.

Suggest you provide us with some more details.

I was recently in a car accident that was not my blameable (I was stopped at a stoplight when a car side swiped me). I was not injured, however there was some damage to my car. This is my first experience with a car accident. I got the indemnity information from the person at fault. My question is do I contact the other persons insurance convention to file the claim, or do I contact my own insurance company?


Story the accident to your insurance company, and file the claim with hers. You want your company to have a record of the accident, in carton she tries to claim that you are at fault.

Her company should pay for your damages.


As to a police report, in many areas, if there is no injuries and all vehicles are drivable, the the heat do not write reports. They have the drivers exchange information, and send them on their way.

Collecting From Car Accident In Small Claims Court (CA)?

My car accident framework gets worse ....

The driver who hit me in fact had insurance on the car, but he did NOT OWN the car (and you cannot insure something you don't own). SO the driver has reported his bond company (Infinity) to the Dept of Insurance b/c he was paying premiums on a car he didn't own and Infinity never checked to see who owned the car.

My NEW, enthusiastically IMPROVED Allstate adjuster has told me to sue the *driver* in small claims court (as she/Allstate will be active after the *owner* for damages, deductible, etc).

I am planning on asking for:
1. Rental car charges (40.24/day by 50-60 days) - as I don't have rental car on my uninsured coverage - since protection is required by law in California!

2. Loss of Value (as soon as my car is fixed... we are at 45 days and it still isn't done) which for a 2007 with 4,000 miles on it will be almost $3,000 (I have visited both CarMax and dealership for estimates).

Am I missing anything?

Suggestions?
1. Disappearance of value (per my agent, it may work b/c we are selling the car and will document through 3 dealerships - cost of repairs are over 15,000.00 and still effective - too bad it has to be 50% of value to total!)

2. I am suing the driver, not my insurance company ... my guarantee policy does not cover a rental car for uninsured collision coverage. They paid for the deductible, the repairs, etc.

3. I have FOUR children to spin - so there is no car with three rows of seats to rent at 25/day. Most of the time, I only have the baby or two youngest, but I can't put a booster derriere in the front passenger by law - so no 25/day for me.

4. So what all do you sue for (small claims in CA is 7,500?) - rental car, loss of value (though it is not a understood), time off work,

5. CA does not allow court/filing fees to be included for petty claims (SC100 form states this)


I don't be informed about your new and improved Allstate adjuster, but let me break it down for you......

The Allstate policy has what's called a Just of Recovery clause in it. What that means is YOU can not do anything to jeopardize their ability to collect back the money they paid to fix your car. THEY have phony YOUR rights since they paid on your behalf. (What they can not do though is subrogate for something they did not pay, like your rental) NOW.....

You can go to humiliated claims court, but 1) you have to sue the DRIVER AND THE REGISTERED OWNER and 2) you have to sue for ALL the monies Allstate paid out on your assert + your deductible. If the TOTAL amount of money paid out exceeds the small claims court entrance, you have to file your case in civil court. Also, you can not sue 1 person and Allstate the other, you have to sue them both for ALL damages, and only 1 of you can do it.

In CA, you CAN NOT sue for extermination of value--there is no such thing in CA.

If you take the incorrect advice of your new and improved adjuster and sue the driver for scarcely your rental car charges....guess what? You have forever barred Allstate from recovering their prosperous back and THEY will come after you for 1) breach of contract and 2) the money they were unable to convene. How do I know? I was an Allstate adjuster in CA for many years and I have seen this happen repeatedly to people who didn't mind to me about this same subject and decided they knew more than I and are now in collections.

I Was Involved In A Car Accident. Other Guy Claims I Contributed, What Do You Think?

I was in Nautical port hand turning lane, 10 cars in front of me and three cars behind me (approximately). Guy pulls out of parking lot on my to be honest and crosses over two lanes of traffic (all three lanes including left turn lane was stopped at light-hearted) he passes through the gap in traffic and cuts his truck short and trys to use my left alteration lane as a merge lane to make his left turn beside me and runs into the formerly larboard front of my car. He claims I shouldn't have been in the left turn lane so far away from the light where I was turning ( I was in a edge of traffic, all of us turning left at light (it wasn't even 1/10 of a mile at the) the three cars behind me went around the accident and still took the left turn at the light. the police faulted him lock, not me. who do you think is at fault? We both have Nationwide insurance and they are seriously screwing with me. I got a lawyer, justified want opinions :)
When I looked up and saw him about to hit me, his head was turned looking the opposite government for oncoming traffic. Nationwide won't accept liability until they hear the 911 strip. In the meantime I had to shell out my 500.00 dedcutible to get my car fixed...


What the regulate say goes. If he was faulted for the accident then it was his fault. He was improperly crossing through traffic anyway. I would use my lawyer and get his care for and then if Nationwide still wants to be a butt I would go for them too. How could you have contributed to the accident when you are at a complete stop and not in the wrong. You being in that tendency everywhere lane is a moot point.

How Does Car Accident Claim Work?

I have a 1998 TownCar. I Have Geico Security Full coverage. I was at a red light when i Accidently turned on red and got hit by a suv. I have damage to my front left fender and bumper. Nothing absolutely big. The accident was my fault. If i go through my insurance to fix my car, will my insurance go up?


Most meet it will. I worked at a gas station 3rd shift, I watched a guy try to back up right into my car. Then he drove off real high-speed. I reported it to the insurance and some months later my insurance did go up.

HELP! Car Accident Claims Dispute!?

Hi there, and thanks for intriguing my question.

I was involved in an automobile accident last week. I was hit from behind on the highway by a driver who just wasn't paying distinction. My car ended up being totaled out.

His insurance (Travelers) claimed 100% liability for the accident. I have been checked out and X-rayed, and have no injuries, luckily. The issues I'm having are coming from the choice amount Traveler's is trying to offer me.

My vehicle was a 2005 Ford Focus ZX3. Mileage:46,138. I bought the car new and it was still under a 100,000 mile assurance. They want to offer me their actual cash value of $8,697.

I still owe $3,000 left on the car so that would renounce me with just over $5,000 to try and replace the vehicle with. I feel like since I was not at fault, it would only be comme ci for me to be allowed to replace my vehicle with a comparable one, with a warranty still intact. In the Kansas Metropolis area where I live, I have done some extensive research and found that it is simply impossible to find such a car for less than $11,000.

I have never been in this situation before, I'm a 22 yr old college swat. They will only deal with me since the title is in my name. I am just wondering what my options for coming to an acceptable harmony with them are?

Any help would be greatly appreciated!

Travelers does not owe you the replacement sell for of your vehicle. They do not owe you the cost of a comparable vehicle.

They owe you the fair market value of the tangible car that was damaged just before the accident. That means - what you reasonably could have sold that car for given it's age, condition, mileage, options.

They will not pay you 11,000 for a car you only could have sold for 8700.

Although I don't conscious much about your car - their offer seems to be in line.

Who Gets What In A Car Accident Claim?

How Do I Settle A Car Accident Claim Without A Lawyer And Still Get A Fair Settlement?

I was after ended and my car was totaled. My daughter was in the back and is ok. I had moderate whip lash and did therapy for a combine of months and have been released. The other persons insurance says they are ready to offer something for my daughter. I don't have any evidence what is fair.

Fatal multi-car accident in Kent County

OAKFIELD TOWNSHIP, Mich. (WOOD) - Two women died after a four-car run around noon Sunday along M-57 in Kent County's Oakfield Township.

Corine Dines, 52, and 58-year-old Belinda Shockley died after Dines tried to antiquated Shockley but did not see an oncoming pickup truck, sheriff's deputies said. The two women were driving eastbound on M-57, also known as 14 Mile Way, east of Wabasis Avenue.

Dines is from the Cedar Springs area and Shockley lived in Courtland Township.

Judson Bancroft, 31, was driving his pickup trade westbound and swerved to avoid Dines' Pontiac but then struck the Buick driven by Shockley, according to the deputies. The Pontiac also struck the pickup, they said.

Bancroft, of the Greenville tract, sprained his hand and suffered lacerations to the face and head.

Shockley had four passengers in her car: her boyfriend, 56-year-old Robert Beardsley; her son, 37-year-old Bill Shockley; and her grandchildren, ages 2 and 3. All are expected to subject to. Beardsley injured his neck and Shockley broke his leg. Both reside in Courtland Township and were bewitched to Spectrum Butterworth.
