I got into a car mistake and had 1 other passenger. When the insurance company compensates us for the injury claim, will it be 1 check or 2?

Do I Have To Provide A Deposition Or Statement If I Am In Pro Per For An Auto Injury Claim? |

If I select to handle my own auto personal injury case, do I have to provide a statement to the other AT FAULT insurers insurance suite? I was an injured passenger in my sister's car and the other person was found to be 100% at fault by their own insurance company. Too, can I organize a claim with my sister's insurance and my own insurance? I am not with the same auto insurance carrier (it's been about 2-3 months that I switched), but can I still claim with them? Thanks!
Some of my surrebuttal may depend on your state.... Unless you have an attorney, the only way for the at fault insurance company to approximate your injury claim is to obtain your statement and assess your injury, medical treatment and bills. If your sister was not at answerable, you can file a medical claim on her no-fault insurance coverage (PIP) if she has it, but you can't file a bodily injury (liability claim) against her game plan if she's not at fault. If her PIP coverage exhausts, you may file an excess claim on the PIP coverage on your auto policy which was effectual at the time of the accident... hope this helps :)

Can You Be Sued Personally At The Same Time Someone Has An Auto Insurance Claim Against You? |

My mate was involved in an auto accident last October. The other party submitted a claim to our insurance company this February for familiar injury. The insurance company has determined very little liability and have not been able to come to an agreement on the terms of affirmation. We have just discovered the other party has filed a personal injury suit against my wife. Can this be done at the same antiquated? Is the insurance company supposed to deal with this? If the other party gets paid by the insurance company, would my woman still be liable for damages? What if the insurance company and the other party never come to an agreement? Help?!
Constitutional over a COPY of any paperwork you receive concerning the lawsuit, to your insurance company. If the insurance company cannot reach an compatibility, a mediator will be called in by the courts to settle it. The person cannot progress with a civil ensemble until the insurance coverage is finished and cannot draw two amounts for what has already been paid to satisfy the claim. (This is assuming damages were paid in full through the insurance.)

Auto Insurance Claim With Minor Injury? |

My son was in a inconsiderable fender bender & the nationally known insurance company is blowing up my phone. I told them he is compassion some neck & back pain. No Dr. has seen him.
They want to know what Dr. he saw & where? They also asked if I was going to towards a claim. I told them I was unsure & wouldn't release any further info to them.
My son is not injured other than some soreness, but I don't craving to release anything to them until I'm sure he will not have any further complications.
What kind of letter should I send them? What about any compensation contrive this? I'm very confused & really just want him to be OK without any future issues.

You don't have to turn a claim or answer any questions if you don't want to. If you/your son are ok with just taking some pain reliever and getting over it - that's ok. Most people try to gelt in like they've won the lottery.
However, just some info for you:
It sounds like the other driver has insurance and the other driver was at liability. That carrier is obligated to make sure their driver is released from any outstanding hindrance. If you/your son is going to make a claim - they want to get it resolved.
In order to get it resolved - they need you/him to mark a release. The release will say that you have been compensated and that you agree not to purse anything additional against the other driver.
If you do judge to make a claim - and your son treats with a doctor - you will need to sign a medical authorization. That precisely allows the adjuster to get the related medical bills. That's really no biggie.
The issue is really not a biggie either - but you guys should feel comfortable that all of your concerns have been addressed.
Sometimes - an insurance followers will offer you money just to get a release on behalf of their insured. If you are comfortable with that - that's slender.
Usually - I would recommend waiting to sign until you know there are no complications OR sign an unestablished medical release. This allows you to settle the claim for some money and leaves money handy for medical treatment. (Usually up to a specified dollar amount and set amount of time. Up to $1000 for 3 months for benchmark)
Anyway - it sounds like things are going to be ok with your son. Let's hope it stays that way.

How Can I Negotiate A Settlement Claim For An Auto Injury With Usaa Insurance? |

USAA insurance concern only wants to give me $1000.00 & my daughter $700.00 for our injuries due to their insureds boyfriend who did a fritter away out in a puddle of water and rear ended me. We hurt our backs and necks but they are a bit better for the most part. At least a few days a week we still have to deal with some pain, or stiffness, soreness. The adjuster isnt even paying me for my rhythm off from work. What should I do????I know we could get more but I dont want to hire a lawyer, return I only have until this June 19, 2006 to do something. Help!!! I want to be able to write some off one's feed of letter sounding like I know what I'm talking about.
Ouch! When no unenforceable comes to a settlement with insurance, your best best would get a injury lawyer. In most case you will WIN and don't have to pay a lawyer one cents. Agree with the law bar in San Fransico and ask the clerk to find you good rate lawyer who wins win. Hopefully they will have someone conjunction you. Good luck, i would file, because I had to in the past when I was in a car accient and it was the cop fault. Had to sue the city!

My boyfriend was hit by a winebibber driver while working. Any advice on the best way to collect for injury etc.? State of California
Your boyfriend should put a Workmans Comp claim to pay for any and all medical bills incurred in the accident. Contact the insurance callers of the person that hit him and when you are ready to settle the injury claim (you have 2 years to either settle the injury claim or contact an atty and folder a suit) I would try to settle the injury claim on your own to get the most money. If he has reasonable and related medical bills when you submit them to the insurance transmitter, ask for maybe 5-6 times the medical bills and his lost wages. When you are hit by a plastered driver, the amount that is paid to you usually is higher than a normal settlement due to the gross laxness of a stupid drunk driver. Good luck and I hope he is ok.

i met with an extra in the parking lot of a shopping center when the car i was parking accidently hit the showroom window. an worker has filed a personal injury suit against me. i have insurance coverage of 15k. can the judge grant a higher amount and if so what will occur if i cant afford it?
Your insurance coverage limits do not lay down the law what a judge will do. Yes, he CAN grant a higher amount than $15k if he feels that the damages exceed that amount.
If you can't give forth entangled with anything then don't worry about it. They can sue you, but if you don't have any assets there's nothing they can do to collect.
In some severe cases, they CAN withhold money from your salaries but that is wholly dependent on the case and the judge.

My boyfriend and I got into an fluke, where he was at fault. Although he was the driver, the car's mine and I'm insured under it. I've already filed an insurance claim and I'm getting an appraisal right now. The car had far-away damage to the front (hood crushed, bumper torn out, headlights busted, grille pushed in, radiator cracked, and antifreeze profitable leeking out). The car is a 2006 Toyota Avalon w/ 24,000 miles on it. Is it possible that it's totaled?
It's been days since the serendipity and we're both suffering back and neck pain. If we go to a chiropractor, how will the insurance money be paid out? Also, how does the Unfriendly Injury Protection coverage work? Is it the same as pain & suffering? Do you ever come up short with banknotes for the bills? I'm real clueless as to how this ordeal will work out. Help!

Since the car is in your name, and he was driving it with your sufferance, the claim will be made to your insurance, since insurance follows the vehicle, and not the driver. It is very possible that your car is totalled, there could be more damage that you dont positive about under the hood, or in the frame or suspension. The vehicle and injurys will be handled like this: The vehicles bill will be handled under collission coverage, you will be compensated for the damages to the vehicle, and it will be repaired, or if its totalled, they will pay the failure-payee if there is one first, and then you, all payouts will be minus your deductible. The injurys for your boyfriend will be handled under your medical payments coverage, and if it exceeds that amount, it should be covered by the bodily injury coverage. Your injurys will only be covered by the medical payments coverage, and if it exceeds, you will have to pay the lean, or claim it with medical insurance if you have it. Any other questions, call your insurance agent, he/she can help.

i had them for two years they were contemptible, ripped me off. i had so many problems with that company!!!!!!!!! i have NJ CURE now and there great never any problems. I'm stark you have them get rid of them as soon as possibly.

Last week, in answer to an analyst’s question, Juan Andrade, president and chief operating public servant for property and casualty operations at the insurer, said that “what we are seeing is an uptick in auto frequency, especially in auto liability…” Mr. Andrade said the upswing was “clearly driven by an rise in miles driven as gas prices have become more normalized.” In the third quarter of 2008, he noted, “gas prices were significantly higher. Miles driven came down precipitously and now we are starting to see them surface back up.” The frequency increase, however, will probably not be a consistent pattern throughout the nation, and insurers will be impacted differently depending on where their books of occupation are located, according to Robert P. Hartwig, the president of the Insurance Information Institute in New York.
