Should I Get A Lawyer After My Motorcycle Accident? |

was recently hit while riding my motorcycle. I glowing in Las Vegas, NV so everyone is sue crazy out here. Everyone tells me I should get a personal injury lawyer to get be a settlement check. The man stopped and his surety is claiming responsibility. They have given me no problems and have been very nice. They're sending someone to get an estimate on my bike Monday. The accident was plain. I was riding in the far right hand lane and his car merged into my lane. I slammed on my brakes but didn't answer in time and his back bumper hit my front tire. The bike laid over on it's right side and both the bike and I went skidding across the pavement for about 50 ft. My injuries are: a twisted ankle and course rash on my right arm (light) and right knee (severe). I went to the doctor afterwards and the guarantee company said to send them my medical bills so they can settle. What are the pros and cons of getting an attorney? Should I be sue well-timed or trust the insurance company? Please help
My bike has a lot of cosmetic damage to the precisely side and I'm pretty sure the front forks are bent because I have to hold the handlebars at an angle to prod straight. Also my husband says when I sit upright the back tire leans the opposite way that the handlebars have to be turned. The bike sounds horrid but that might be beacuse the exhaust pipe is dented and scratched up and is now out of tune. I'm guessing that the bike is totalled. It's an 07 Ninja 250 and has fair under 3000 miles on it. I'm pretty sure the cost of fixing it would be more than it's worth. I'm definately not current to sign anything without legal advise but I hate people who are sue-happy and I'd hate to be a hypocrit. Documentation news though, if they total it out I can get a new ZZR600 or 650R like i've been wanting. :P Yes I'm stupid for insufficient a bigger, faster bike after wrecking my old one but I refuse to give up riding.
Thanks for the ideas. I only missed one day of line (because I was in the doctors office) and I don't think I have any lasting injuries. The only thing I could think of is I already have neck problems and this quite wont's help those out much.
First you should understand a lawyer isn't necessarily going to get you a windfall of money. And what you do get you can take out what the lawyers fees are.
The questions you have to ask are, did you evade any work due to the accident, and are there any permanent affects to any injuries from the accident. What a settlement will cover is lost receipts, ability to earn the same income, medical costs and future medical costs for a perceived developing medical problem (if there is one), repair or replacement of the vehicle.
I had a fairly serious accident years back. Had an attorney grip it. I was in the hospital for nine days and out of work for four months. Although the dollar amount of my settlement sounds like a pretty large amount out of that settlement comes medical bills (which were extensive), replacement of conduit, and the twenty-two percent my attorney gets and he was a personal friend.
If you didn't miss much or any line and have no serious injuries you might be best not to spend the money for an attorney. What I can tell you is don't sign any press papers. The insurance companies what you to sign a release so they are relieved of any future dependability. For instance head, neck or back injuries even though not severe can cause problems in the following. The longer you hold out in signing the release forms the better the offers get. After all you will have to sign but don't do it until your comfortable with the agreeement. The insurance companies don't want to give you any more than they have to and you shouldn't decline for any less than you deserve.

I Was Injured In A Motorcycle Accident And Not Sure If I Should Get A Lawyer.? |

I was hit by a car that failed to concede while he was turning left and I going straight. He was ticketed and at fault. I suffered a discouraged leg that required two surgeries and 3 days at the hospital. I only have liability but have been told that the other person's warranty "should" cover the costs.
I am not sure if I should hire a lawyer but should I? Is it possible that the other assurance wont cover everything, including pain and suffering and loss of wages? But my prime concern now are the medical bills. Very expensive I am sure.
If I do go with a lawyer, is there a point in time where it might be too current? It has been a week and a half since the accident. I know they would not want me talking directly with the insurance and things like that.
Thanks in advance. I hope to be on my feet again very soon.
Thanks to everyone who has replied. I felt like I needed a lawyer rectify away but didn't know I have up to one year to do this. Now I will take my time in choosing one.

I essential a sample of his blood to be able to do a DNA test to prove that he is the father for legal reasons. Does anyone distinguish if I need to hire a lawyer? or if I can request it personally from the crime lab? I am so upset and stressed about his obliteration and on top of everything, I am not getting straight answers fromt he police and sheriffs. Why Are You Afraid To Answer A Lawyer Question? |

I ask a doubt about lawyers and nobody answers. Do they have that much power? My TV sound gets off, or I change channels, or I instantaneous forward tape when a lawyer commercial comes up. Why do I hate them?
Because a lawyer got money from me on a motorcycle accident that was NOT my fault, that's why. (Perhaps I should sue that lawyer. But he would counter sue me and probably win.
My problems with lawyers is that they turned our "law" system into a farce. It's not about justice anymore, but about finding loopholes and exploiting them. They don't produce the laws fit the crime, instead they try and make reality fit the law.
If a robber breaks into your outfit and hurts himself while there, he can sue you. Every normal rational person thinks that's ridiculous. He broke into the diggings, he should have to pay for himself and the damage to the house, yet a lawyer won't see it that way.
They see that the law states that anyone hurt on your property is your responsibility, therefore you need to pay. They snub reality so they can win an argument and make money.

Motorcycle Accident Without License.? |

I condign got into a motorbike accident without a M Class license. I have a card to show that I have completed the course, and if I take the card to the DMV they will give me a motorcycle enable. I did not have the card on me at the time of the accident, and now I have to go to court to fight the case. I am wondering if I need a lawyer, and if it will be strict to get this ticket dropped. Technically speaking I have a license, but I didn't have it on me at the time. What should I do? Any suggestions?
OK. I did get the certificate before the accident, and I don't have motorcycle security because it is not my bike and I didn't have a bike at the time. Will I still be OK? Should I go to court with the Driving Certificate, or should I go the DMV and get the M Realm License made? Do you think I need a lawyer?
Oh yea, There was no damage to anything except the motorbike. No other vehicles were involved.
At this spotlight, you are guilty of improper license classification. If you can show the date that you completed the course, and have your commission corrected ASAP, you shouldn't have a problem in court. The only question is will your insurance be valid, at the age of the accident?

I Was In A Motorcycle Accident 5 Years Ago And Just Received A Lein For $51,000 , Who's Responsible For This? |

Okay, so 5 summer's ago I was in a motorcycle accident where the other reception was 100% at fault which resulted in a fractured femur and severe internal bruising. I now have a rod and 3 pins in my in a beeline leg. I hired a personal injury lawyer immediately who handled EVRYTHING. The case took a very desire time to settle (almost 2 years), but eventually I got the money, and the lawyer took 1/3. Allegedly everything was taken care of, including all medical bills which the lawyer said he had negotiated down and took circumspection of. Now it's been quite some time (about 3 years) and last week I received a very unexpected lein for $51,000 in medical bills. I approximately had a dam heart attack!!! I contacted the lawyer and he said I don't know whats succeeding on, he said the hospital said I was all set and now this. He said something about him having to compensate me for this amount because it was supposed to be enchanted care of under signed contract...? He really confused the heck out of me and I'm in fact still waiting for an update from him. I'm just looking for some feedback on this from someone who knows what they're talking about. Who's managerial for payment and if he does have to compensate me does it have to be paid towards lein. This has been extremely frustrating, do I get to card malpractice!?
If I remember right, it did say that on the lein that the accused party responsible is that of the guarantee company of the woman who hit me. But from what I know I already signed a contract with them that I cannot seek out any more compensation from them.
OK... Don't get your panties in a collect and have a hissy fit because the answer is quite simple actually.
OK, you said that last week you received a very unexpected lein for $51,000 in medical bills and you hunger to know who's responsible for paying it. Simple and here's what you do. Look at the lien very carefully and somewhere on it will say in all respects who is responsible for paying it.
A company cannot send out a blanket lien without stating on it who is accountable for payment. I guarantee it. Look at it very closely and somewhere it will say who the lien holder believes is top.

Should I Hire A Auto Accident Lawyer? |

Yesterday I was active in a 5 vehicle auto accident. I was waiting at the stop light to turn left and a ends and a motorcycle collided in the intersection. The motorcycist flew up in the air and landed funny. The truck kept thriving and I noticed how fast it was going towards me. It hit my car head on and pushed my car back about 1.5 car lengths in a 90 rank angle. The truck bulldozed into a nissian truck and GMC Yukon. Obviously from the photos, it proves that he was current at a fast pace because of the damage and for pushing a still object that far.
The motorcycist may have passed away and wrong scene detectives arrived to photograph the area. The road was closed and traffic was detered. My car suffered commodious frontal damage and my radiator was cracked in half. I suffered no fractures, but I am very embarrassing today. I went to urgent care and the doctor told me to see my PCP to have her review if I should see solid therapy.
My friend suggested a lawyer because the accident could be manslaughter and because one party hit 4 different cars. I into my car is totaled and I will be sore for a while. To this extent, should I hire a lawyer because of the occurance and because the driver at fault's guarantee might try to screw me over because they have to pay for 4 parties cars, and maybe a wrongful death suit.
If so, would the lawyer command sure I get compensated well for my totaled car? I know this is going to be a huge inconvenience.
It wasn't about making a profit, I am uneasy that I will lose out on a car or not get paid enough to purchase a new one. I just bought it 2 years ago.
i would hold on a little bit to see what shakes out the lawyer will get one third for something you may be able to do yourself. you have quite of bit of time before the statue of limitations runs out on a lawsuit

I Was In A Motorcycle Accident Over A Year Ago. I Still Have Not Received A Settlement. How Long Does It Take? |

I was injured in a motorcycle accident last year on 7-7-07 when a lady made a rat on in front of me. Her insurance admitted fault. I have had a ton of doctor and therapy visits. My lawyer says he's working on the crate and has told me he submitted the demand letter. He's a friend of the family; however, he has a ton of cases on his hands, and I'm a dollop worried.
Someone told me that it should only take 5-8 months; a year at most; to resolve a PI accident case.
After the requested letter, how long should I expect? Does it sound like I'm in compelling hands? Is this timeframe normal?
Thank you all so far. I forgot to mention that the case is under California realm.
In an update to an answer posted by 'maila', I was told I only have 2 years to resolve the protection or it is voided. Is this true?
1. Yes the timeframe is well-adjusted. It can take more than one year (sometimes 2-3) to resolve a personal injury case;
2. Has your attorney filed the lawsuit already? If not, turn sure he does not forget about the statute of limitations. Depending on the state, it is a one to three year statute of limitations for actual injury cases.
Sometimes the insurance company needs the "prod" of a filed lawsuit.
3. Even if the protection company admitted fault, that doesn't mean that they will give you whatever you ask for. Multiple therapy visits are predominantly considered suspect (although, since you were in a motorcycle and not a "regular" vehicle, not as much).
4. If you don't feel untroubled with this attorney, let him know and go and find another attorney. But, your current attorney may be able to put a "lien" on the cover (for all the work he has done thus far) and your new attorney will take a percentage of your settlement as well, so maybe this friend of the family will take less. Who knows?
Bowdlerize: Just saw your new information re: jurisdiction. The statute of limitations to file the lawsuit for adverse injury is 2 years in California. So, if this case is not resolved within 1.5 years of the offence date (December 2008, but obviously, no later than 7-7-09 [although, I would do it no later than 7-6-09]), have your attorney case the lawsuit. Maybe the defendant (woman who hit you) can be served on Christmas. *lol*
It costs about $300-500 in filing fees and the lawsuit may delegate the claim resolve quicker (but obviously, there is no guarantee that it will make the claim alter into quicker).
Also, you only have five years from the date the lawsuit is filed to have the case brought to irritation. If you're in a county where civil cases aren't tried often, due to a criminal backlog (like Riverside County), all I can say is "safe luck!"

The fifth child sustained non-life threatening injuries and was transported by emergency medical services (EMS) teams to University Medical Center for treatment by doctors and nurses. The driver of the Buick also unceasing multiple injuries and was taken to UMC for treatment.
