Who Is At Fault With This Semi Truck Accident-police/lawyers Only Please? |

A semi truck driver, was on a approach that had a passing lane. He was in the right lane- when the passing lane was about to end a car behind him decided to unfashionable. He hauls haz-mat-so he had to get on the road (he had his turn signal on for a while-so the car knew he was getting over) or else he would have gone off the approach. The car was about 1/2 way up the trailer (not even to the truck yet) when another car was coming the other way. the trucker couldn't pull off the road with out causing a very threatening haz-mat situation and instead of the car behind him slowing down-they freaked out and drove across the other lane and went off the side of the means. He called his dispatcher and they told him to keep going. The car going the other way stopped, but the trucker couldn't based on his hazerdist non-spiritual-he would have stopped traffic behind him. He doesn't know if anyone was hurt.
What will-or could- happen now? How can he care for himself?
Just finished talking to a lawyer and based on everything -the trucker had the right of way and based on the position he is not is the wrong!!
Depends on what testify he was in. It wasn't hit and run or any thing, but it would depend on if they have a good sameriten (spelling) law. Plus did he call 911 and write-up what was going on, if so they would have a record of him calling and at least trying to get help out to the scene. But I know in this zealous world everyone always wants to blame the big truck driver. I know my husband drives over the track, and I work for the sheriff's office. Good Luck

Should I Get A Lawyer To Represent Me For An Accident I Had When I Was 7 Weeks Pregnant? |

I was in an accident last week, I was hit from behind by a Decay Manement dump truck and hit two other cars on the freeway, my car was totaled. I am also pregnant. Many of my friends and household members told me to get a lawyer to get some money of the BI part. I really wasn't hurt but when I went to the doctor they couldn't in reality check if the baby was ok because I was only 7 weeks pregnant and they said it was too early to even hear a heartbeat. My adjustor said that they are current to leave the BI claim open due to what the doctor said. I had called a lawyer before and she told me to respite it out because once you get a lawyer involved it makes it a mess. Should I get a lawyer?
Let me add something for people that are taking this the wrong way. ... I am only judgement about my child.. Because if it was for me I would of already gotten another lawyer to sue them...and another thing is knowing that I am not hurt I wouldnt want to agency a company to pay for something as frivoulous as that..I am an honest person with a conscious. Thanks for the helpful answers and not the judging ones.
Power now, you have nothing to claim. You said you have had no bodily injury and it is still uncertain your child does. Getting a lawyer at this hint would be a waste of time.
If the baby is found to have complications and the doctor suggests it could be from the accident, then get a lawyer.
In the meantime, don't mark any settlements or waivers concerning bodily injury from the insurance company until you be informed more about the baby's condition.

I was hit by a truck driver (he ran a red and admitted it to the cops). I have been in navy surgeon therapy for a while now, soft tissue damage to my back. I'm trying to handle my case without a lawyer. Barely wondering, does anyone know if truck accidents get bigger settlements? It was a small semi and it munched my mean sedan into a tin can.
I have settled cases in and out of court. The honest money didn't come until the very last minute where the threat of going to court and the uncertainty of the consequence was imminent. In a serious accident I would get a lawyer, but not right away and not until you have made an attempt to settle. The longer you can hold out the more paper money you will get and insurance adjusters know the sooner they settle the cheaper they settle.

today i got into a car accident. my 2007 yaris which i have had for less than a month was side swiped by a performance truck which in turn made me crash into another car. the impact from the delivery truck made me lose control and slam correct into a the steel bar hitch on a lifted truck. the damage to my car is pretty bad. so far i am uninjured with a little hurt in my back side. should i seek legal action for this collision. i have never been in an accident before and this is causing me a great deal of heartache because the car is probably totaled and i cant make it to work. the accident was the truck drivers fault, he even acknowledged he heard my horn. what should i do?
Wow, it seems like everyone here is forgetting that this is a emancipation truck that hit you. While I agree with everyone else's suggestion that you go see a physician then a lawyer, you have to realize that the driver's company AND the company's indemnification carrier are now liable to you for your injury. It's more complicated than Joe Somebody hitting your car. Your injury may seem very trivial but it can be latent and manifest itself at a later date, say, after you've settled with the company and it's insurance porter.
My advice: do NOT try to settle this on your own. The company owes a duty to those on the road that its delivery trucks will not wrong anybody. Plus, the driver has already admitted fault and that admission is imputed onto the troop. If you settle yourself without the aid on an attorney, you'll lose yourself more money. Sure, an attorney will take some of your money, but would you rather them take a niggardly percentage out of $20,000 (for example) or only get yourself $2,000 by settling this yourself?

recently I had a car accident, a semi truck bum ended me totaled my car, I had neck injury. the lawyer recover $7500 for me(included all medical, car rental expense), he need to charge me $2500 33.3 % of the settlement . But however my medical expense is $3500 and my rental car car expense is $800. This basically off $700 for my wage lost and other pain and suffering. my question is can lawyer take a percentage on my medical bill, rental car which in my way of thinking those arematerial demage, and I think they should just take the percentage from my wage, pain and agony demage. Please advise regards

Well medical expense and car rental expense I could redeem without lawyer. Because these arewith a fixed cost. I had an accident 10 years ago and I just files the cliam against the other fete's insurance company. They assign me a rental car the very next day, and also they pay for my emergency room visit. since this mores my accident was more serious I hire a lawyer. but however he didn't get me a rental car the lawyer ask me to go rent car out of my pocket first which I think their motive is take a part on my rental car expense they recover. so that why I think why should take a percentage on my rental car expense (they couldn't get a establishment for the demage of my car for 4 weeks so I had to paid 800 dollar for rental car the lawyer could've just ask the bond company to rent a car for me) and medical expense is fixed cost as well. the motive is actually questionable
Yes he can take whatever you agreed to and signed for when you hired him. (Look over your agreement with him) As you are finding out, a lawyer is not always the best way to go

Yesterday I was labyrinthine associated with in a 5 vehicle auto accident. I was waiting at the stop light to turn left and a truck and a motorcycle collided in the intersection. The motorcycist flew up in the air and landed odd. The truck kept going and I noticed how fast it was going towards me. It hit my car head on and pushed my car back about 1.5 car lengths in a 90 limit angle. The truck bulldozed into a nissian truck and GMC Yukon. Obviously from the photos, it proves that he was contemporary at a fast pace because of the damage and for pushing a still object that far.
The motorcycist may have passed away and offence scene detectives arrived to photograph the area. The road was closed and transport was detered. My car suffered extensive frontal damage and my radiator was cracked in half. I suffered no fractures, but I am very irritated today. I went to urgent care and the doctor told me to see my PCP to have her review if I should see sawbones therapy.
My friend suggested a lawyer because the accident could be manslaughter and because one party hit 4 different cars. I assume trust to my car is totaled and I will be sore for a while. To this extent, should I hire a lawyer because of the occurance and because the driver at fault's protection might try to screw me over because they have to pay for 4 parties cars, and maybe a wrongful death suit.
If so, would the lawyer produce sure I get compensated well for my totaled car? I know this is going to be a huge inconvenience.
It wasn't about making a profit, I am nervous that I will lose out on a car or not get paid enough to purchase a new one. I just bought it 2 years ago.
i would intermission a little bit to see what shakes out the lawyer will get one third for something you may be able to do yourself. you have quite of bit of time before the statue of limitations runs out on a lawsuit

The unidentified driver of the UPS 18-wheeler was reportedly traveling westbound on I-84, when, for unnamed reasons, he failed to slow down as he was approaching slower moving traffic. A semi truck carrying crane parts was hit from behind by the UPS semi, who then jack-knifed after clipping the other semi’s tushy right side. The crash was so violent that it ripped the cab of the UPS semi right off of its frame. The UPS driver suffered a concealed traumatic brain injury (TBI) and was transported via emergency medical services (EMS) teams to Stand up to River Valley Hospital in Trenton for treatment. A passenger in the UPS big rig, who was in the sleeper of the cab at the dated, managed to escape the wreck without injury. It is reported the two occupants of the UPS semi are from Colorado. The driver of the other tractor-trailer did not put up with any injuries. Police officials believed speed was the probable cause of the topple. Officials are currently investigating the two-vehicle wreck.
