Advice Please - Car Insurance Claim, Hit By White Van Man, Not My Fault, Now He's Claiming I Hit Him?

Back in May a whey-faced van man changed lanes on the dual carriageway without looking and pulled into the drivers side front wing of my car, hurt not significant - probably about £500 worth, but you can't really tell it's been hit, more scraped. The other driver was very hair-splitting, apologised profusely, said the sun caught his eyes etc, and to call him if there was a problem. I immediately reported it to my insurers, not gravid any problems. Over the past 3 months this other driver has turned quite nasty with me, after having told me to get a R and he'd pay it, he changed his mind and told me to go through the insurance. He finally reported the accident to his insurers last week, telling them that I drove into the back of him, but that I caused no disfigure to his vehicle - which is why he never reported it until now. My premium is due for renewal in October. Do I continue to fight this - not second-rate to let him get away with it, or let it go? Might I lose my no-claims bonus?
If this goes all the way through the legal process, and he's not found vulnerable will this cost me money? Will I have to pay up for time spent by the insurers working on the case? I can't grant to lost my no-claims discount. I have legal protection, but no witnesses to the accident or the conversations he has had with me and my old man where he has admitted guilt and been apologetic.


Im ill-starred this has happened to you, its a horrible and stressful scenario. i'm going to presume you are insured fully extensive.
Firstly, im afraid it would not be as beneficial as you think to drop your case now. Because you have already informed your ins comp, if you drop-off the claim, you still have to inform all ins companies if you want a quote. Any further quotes from your comp or any other will show you having a " claim with no impoverishment of NCB". This can still have an effect on your premium.
Secondly, if you do pursue this, and it is settled as a 50-50 claim (where the ins attendance cannot determine who is at fault), you will lose your NCB, unless it was protected. Check your ins policy forms.
Thirdly, brake your docs to see if you have Legal Cover. This is usually added onto a policy almost automatically and is up to a value of £50,000 - £100,000. This will pay for all your authorized costs, you will not have to pay a penny (no claim ever goes over this amount so dont worry about that either). If you dont have this included, control your home insurance policy for it, you can use this too.
You say your renewal is in October. If you choose not to fight this, your renewal will be based on you having had a claim even though you chose not to go through with it. As I said before, this is because you have already cultivated your ins comp about it. It will be at your ins comp's discretion if they are going to penalise you financially for it...they may do because they will be aware every firm will. contrary to previous answers, If you choose to pursue this, your ins company will undertake a "worst receptacle scenario" regarding your renewal premium. This means you will be sent a renewal stating you have an turbulent claim, they will reduce your NCB and increase your premium accordingly. The reason for this is that should the claim then be settled in your favour, your NCB and reward will be sorted and they will refund you all monies due to you (backdated to the start of your policy date). All ins comps do this because it is easier to refund in money than it is to increase a premium and chase money , should it be settled as fault.

I Need Some Legal Advice About An Insurance Claim I Submitted To My Car Insurance Agent?

I in reality have two claims and wondered if I will get reimbursed.
1) $379,431.34 requested reimbursement for repairs to my truck shanty. The damage was caused by attacking fighter jets.

2) $665,789.11 requested reimbursement for repairs to my trailer. I claimed the bill was caused by a giant mechanical scorpion, which I can only assume is some amusement-park take in, although I question the wisdom of bringing my mobile home so close to such dangerous gear.
Since becoming a Acme Insurance customer in January of this year, I have reported 131 accidents, requesting reimbursement for repairs necessitated by each one. I also have claimed not to be managerial in any of them, usually listing the cause of the accident as either "Sneak attack by Decepticons" or "Fixed damage caused by protecting freedom for all sentient beings."

Do you imagine I'll win this time?

Advice On Car Insurance Claim?

2 days ago a guy tried to nip through a gap in front of me whilst i was stationary waiting in movement, he miss judged it and his rear driver side panel hit my bumper, we got out and it was pitch deadly so we could not see any damage, we exchanged phone numbers and took each others reg down.In the morning i checked my car and there is NO destruction, however i am now getting text's and phone calls from this guy saying that his IS damaged and he wants £100.This disturbance was not my fault but i'm worried that it could go against me as he may say i drove into him. Has anyone got any advice thanx


First of all set your insurer immediately. Now, today, and tell them what happened.

tell them the truth, that you were stationary, and let them chapter and verse including drawings of what happened.

Then ask your insurers to pealing this guy and he may back off, sounds like he is trying it on more than a bit. He needs to give YOUR insurers HIS insurers details. DO NOT give him any folding money. The correct way to deal with this is through insurers.
If he doesn't stop harassing you, even after this, tell your insurers, and chew out tattle on the police.

It may be if his damage is below his excess, his insurers will just tell him to pay it and be done with it. I presume he is in truth insured, because there's a whole world of pain there for him if he isn't, and I wonder if that's why he's coming on to you so hard?

If miraculously (and this has been known to hit on) the claim suddenly inflates then it may be, without witnesses, that your insurers will agree to settle 50/50 - you stress to keep on at your insurers not to accept this, as it a) wasn't your fault and b) it will affect your no claims bonus if it isn't protected....it could end up in court, but insurers will try to into order out of court on a 50.50 basis.

If all he is after is £100, speak toyour insurers, and let out them EVERYTHING, they will advise you. I repeat though, DO NOT PAY HIM ANYTHING, and keep the texts and voicemail messages.

Advice About Filing A Household Insurance Claim For Car Break In

Last week we received a call ahead of time in the morning from my husband's corporate card stating that they suspected fraud. At that beforehand my husband noticed his wallet was not in the house and he figured he must of dropped it somewhere. Well, a couple days later I was looking for a few items that I recognize were in my car and they are missing. I then start to really look and find that several items are gone - Passport, CDs, iPod, Crash Cancelling Headphones, my watch, sunglasses, my son's perscription glasses, etc. (I know we are mum for having this in the various compartments in my car, none were out in the open)...However, we filed a police article and find out that we are 8th person in our neighborhood to report a break in. I called my insurance company and was told that it would be covered under our household principles but then was told that they had a lot of limits on the $ amount for specific equipment (electronics, household paperwork like my passport). I have gone through my system and no where can I find these limits. Is this pretty typical? Please, if you have any advice we would appreciate it. It has been an awful week dealing with shutting down reliability cards, etc. we don't want another headache....


Every homeowners means except one, that I've ever seen, has had "special limits of coverage". Strain attract your policy, go to Property, Section I perils insured against, Coverage C, personal capital goods, Special Limits of Liability: $200 cash, $1,000 securities, $1,000 for watercraft & trailers, $1,000 for jewelry & watches (defeat by theft), $1,000 for electronic apparatus. Many policies limit the coverage for cd's to $100 or $250.

Paperwork isn't covered for "get to replace", but "value of the media" or blank MS. Electronics that are powered by your car, ONLY, are likely flat out excluded.

And of course, this is all subject to your quiddity deductible. I know, bad news, on top of being violated. Just what you need.

Buying A Second Hand Car And Need Some Advice On Insurance Claims?

I was planning on buying a next hand car from a dealership. I got the serial number of the car to do a Car Proof check.

Well, I found out the car was in an accident (the merchant said it had not been) but what concerns me is that it says that "the insurer has not yet paid out the claim".

Does this abject the repairer of the car has not yet been paid, and if so, if I purchase this car, will it make me liable for the payment?

It could be that the communiqu has not been updated. If there are no Mechanic's Liens on the vehicle then, the vehicle is clear to purchase. However this doesn't petty that a mechanic won't put on a lien an hour from now, tomorrow or the day after. It's best to contact Car Proof and accredit this.

Car Insurance Advice Please?

ok a year ago my hubby had a car calamity, it still isn't settled and just had a renewal for our car insurance, more than double what it was last year, they've said its because they've took off the no claims because they don't identify which way the claim will go, even though we've been advised that we will win, the only thing i think is wrong is that were no claiming on the car insurance were claiming through a solicitor..can someone take me here i don't know what to do


What I have found is everytime my insurance renews... I go out and reference with about 5 different companies....

I have saved about 700.00 a year this last time I changed companies...

Can You File An Car Accident Insurance Claim Without A Police Report?

this is re: a very lass accident. our car "bumped" into the other car after they slammed on their breaks. No damage at all to our car. The enable plate and screws are "bent" on the other car. Other person uncooperative and after we gave our insurance info to them, refused to give info to us. Monitor on scene did not file report, told us to just deal with it on our own. My worry is, can they complete a claim? wouldn't it be just our word against theirs? advice would be helpful thanks.


Yes, they can systematize a claim and claim you did damage to their car and they now have whip lash. You should have told the police they were refusing to give you their information and it could have been dealt with at the conditions.

All you can do now is file with your insurance so they will be ready when the other person tries to scam you for bunches of money. If the boys in blue were there, even if they didn't do a formal report there should be something on the log about it. As I said, report it to your insurance with all the information you have, and hope they will do the open thing. Hopefully you did get the license number and make and model of the car you hit.

I Need Fender Bender Advice...? Can I Still File/act Upon A Car Insurance (USAA) Claim (its Been 3 Months)?

i was in a fender bender on February 4th, where the driver bumped into me, didnt issue alot of damage (or so i thought)...which was basically a few scratches. We exchanged telephone information (drivers license and car insurance information). I offered to not call the car insurance company and let the driver pay me under the flatland at his convenience (so it could possibly be cheaper for him). I called my car insurance company a few minutes after we parted (i have USAA) to tip off them that i was in a fender bender. I then went to a few companies to see what the price/estimate for my rear bumper was and it totaled about $600. I have been in phone with the guy who hit me off and on, but he has not gotten around to pay me for the damages. Not acting upon my insurance, can i still file a claim? its been nearly 3 months since the collision. Is there a generosity period though my insurance company???


Of by all means you can. But the insurance company will give you a lot of heartache for waiting 3 months. By not reporting it, they may even deny the claim.
