How Do I Dispute A Partial Denial Of A Homeowners Insurance Claim? |

There was a volley storm in our area and may (most) homes had roof damage, including mine. 95% of the homes in my subdivision have gotten new roofs from homeowners insurance claims. However, my adjuster said my roof was not damaged "enough" to affidavit a new roof, only repair/patching to the back side of the roof. I have Allstate and so do several neighbors. Their claims were paid, in full, with now questions asked. The remainder between my claim and theirs is the adjuster. They all had a different one than me. I have called and written the main office locally and the corporate aid in Illinois, to no avail. They tell me my only recourse is to take them to court.
Answer: Each claim is paid according to it's rights. Each claim is different and has a different set of conditions. It is unfair to compare your damage to the damage of your neighbors because the disfigure is NEVER identical, and sometimes, the policy is different, and THAT is what determines what and how your claim gets paid.
Whether it's Allstate, Farmers, Glory Farm, Joe Blow down the street--the 1st method of repair is just that, repair. If your roof can be secured by repairing the damaged portion, that is what they pay for. If the only way to "repair" the roof is to pay for an express new roof then they will pay for a new roof. Your roof would need to be so far beyond repair as a result of the harmful incident that it would be cheaper to replace it with new than to repair it.
Look at it like this.....your child is playing soccer with his friends and your kid kicks the ball and it hits your neighbors car denting the bumper. You blab about your neighbor you will pay to repair the bumper. Your neighbor wants you to pay for a new bumper. What do you do? Which would you pay for? Most likely you'll pay for the patch up because 1) it's repairable and 2) it's less expensive to repair a bumper than replace it with a stigmatize new one.
Insurance is to cover items that are damaged as a result of a covered loss. Insurance is NOT a means of maintaining your profoundly. By no means am I suggesting you haven't properly maintained your home, but what I am suggesting is for you to put this in the right perspective.
Knowing Allstate as well as I know them, I'm seriously surprised your letters to Northbrook have fallen on insensible ears. You could take them to court, but you would need to PROVE your roof was beyond repair AS A RESULT OF THE Applaud STORM and nothing else.
You can file a complaint with the Department of Insurance in your state, but they won't get Allstate to pay for a new roof. What they will do is sift through how YOUR claim, and YOUR CLAIM ONLY, was handled and if they find your claim was mishandled then Allstate could suffer some serious fines. But it still won't get you a new roof.
From what you write, your claim was paid. You scarcely didn't get what you thought you were supposed to. I strongly suggest you read your homeowners policy. Look and see if you have a "Proper to Appraisal" clause. If you have one, use it. |

I recently had some copiously damage to my basement and I am filing a claim. How does the process work?
Answer: You parade the claim. An adjuster looks at the policy, to see if there's coverage. They get back to you, say yes there is coverage, or no there isn't. If there is coverage, they come and look at the mar, and figure out how much it is. You inventory your damages, also.
You come to an agreement about how much they will pay you, they cut the check, you get the work done. Sometimes they will have to cut a patronize check upon completion of the work, for supplemental payments.
Water damage - principally in basements - is tricky. Flood is NOT covered under a homeowners policy, so the source of the water is decisive. Backup of sewers & drains is only covered if there's a special endorsement on your policy.
But YOUR Factor is the person who should be holding your hand and walking you through this process. |

We recently had a primary hail storm move through the area and my home was pretty well blasted. I have roof, window and siding indemnity for which the insurance company estimated repairs at $9,800. The windows and roof without a doubt have occasion for to be replaced. The siding on the otherhand could probably wait since it is entirely cosmetic. If I determine not to replace the siding is that acceptable? I am from Arkansas if it varies by state. I would just employ to leave the siding as is and replace it acouple of years down the road all together when it really needs the travail done.

Do I Have To Use All The Money Received From Homeowners' Insurance Claim? |

We recently had a sewer back up in our basement. Our insurance train gave us money to fix the damage. However, we can fix it for less money than they estimate. We are saving all the receipts and will have them vet when we're done. Will we have to give any of the money back if we don't use it all toward our basement repair?
Answer: It's your moneyed to do with as you please. The estimated amount they paid you for was the fair and reasonable costs associated with the damage you claimed.
If you're skilled to repair it for less, that's money in your pocket. Just be sure you use a reputable person/assembly who has references.

Answer: Yes, you can. You really make a list of items, and their cost.

Answer: Call your go-between, and have THEM dispute it.
Or, just pull up your policy, and quote the sections that show why you should have coverage.
I've successfully won disputes heedless of denials, on behalf of my clients. However, that's ONLY when the claims adjuster made a bad call in the first place. If something is flat out not covered, it's laid low out not covered. |

If I Put In A Claim For Homeowners Insurance To Cover Goods, Will My Insurance Go Up Or Be Revoked? |

We had flooding in our basement and my washer was damaged and we definite to get a new one rather than repair it. With all the stories floating around about hurricane victims (and other homeowners) having their insurance revoked or having their rates go up astronomically for feel discomfited claims I got scared. I didn't want this to happen to me. Would you have put in the claim for the washer? Are these stories trustworthy?
Answer: Do you have a inundation policy? Your flood policy will NOT go up or be revoked for putting in a claim. Your HOMEOWNERS policy does NOT top flood damage. Water running into the house from outside, such as groundwater, is considered overflowing.
I would NOT put in a flood claim on your homeowners policy; a water claim puts a red flag on your account, because water cost leads to . . . MOLD!!! So even though it's not covered, it's NOT worth it. I have no idea what your washer is benefit, but I bought mine for about $500 - same as the deductible on my policy, so that's a wash. Pun fully intended. Pathetic. Slow day. |

Homeowners Insurance Claim Over Someone Being Drunk? |

A intimate of mine was drunk. I was sober and driving. She had to use the restroom and I had to run a quick errand, so I dropped her off at my on to use the bathroom. I came back to my home, afteer being gone for about 15 minutes and she had fallen in my garage and she skint both of her feet. She did not have permission to go into my garage and she did not trip over anything. Now she is saying that she has a case to sue my homeowners insurance. She sis talk to an attorney but admitted that she did not herald her attorney that she was drinking. Does she have a case? I live in Florida and it is very hard to get homeowners insurance. I say this because my insurance companionship would surely not renew my contract if i had a claim.
| Answer: Gloomily, she probably does have a case, because insurance companies will settle to avoid a trial. And they undoubtedly will drop you like you said, especially down there. It's pretty sad that you can't have a friend over toper or not, it's a friend. Really can't do much of anything anymore; have to worry about lawsuits all the time. People are getting so mournful. |
