Can I Return An Insurance Claim Check Abck To Insurance Company?

I filed an auto insurance claim and they sent me a check. But I indigence to sue the person who hit me myself. Am I able to return the check and have the insurance company send me a release letter saying they wont sue the living soul who hit me? Will they do that? Also am I allowed to get copies of my insurance paperwork from them?
I dont have an attorney. I am taking it to small claims myself.


Answer: You did not give enough low-down to answer. I assume that you have talked to an attorney about this suit. Ask him for the answer.

My mom passed and I have two sisters, The oldest is the beneficiary, we are take as given to pay the funeral home back but she keep telling us the check havent cleared. I think she's keeping it, it has been 2 weeks already.

I Received A Insurance Claim Check In The Amt Of 40K I Have An Additional 5K In Recov. Depreciation.?

I received quotes from several contractors and the are all in the 25K chain. So there will be about 15K left over after the damage is fixed can I keep the 15 K and not go after the 5K in revoverable depreciation?


Answer: Accurate, but I wouldn't spend it. I'd bet you dollars to donuts those contractors are lowballing you, and it's going to be catchy close to $40K in the end.

Also, don't pay any of them up front! Don't sign off that the work is done, until it's done!!!

Does My Mom Keep Her Claim Insurance Check?

Mom got into a two-bit car accident where the at fault driver's insurance company sent her a check for the damages to her car. Right before she was common to get it fixed she got into a near fatal collision which resulted in her car being totaled for good. a check in on the way to me for the replacements of scullery cabinets damaged by busted water pipe.
They said I'll have to go get it endorsed by my mortgage lender.
Is that communicate I have to open an account with the lender and deposit it?
or they'll endorse it and I can deposit it in my own account at weird bank?
How does this whole thing work? What'll happen if some money left over after servicing?


Answer: it in reality depends on how much the check is for. you do not ALWAYS have to turn it over to the lender! we deal with this a lot and most times the lender has a local part bank that they allow you to take it to for endorsement and then you can take it to your bank and cash or deposit it. i in fact had a waste on my home and the check was for just under $5000 and my mtg had a local branch that endorsed it and i then cashed it to pay for repairs. call your mortgage, they can reproach you their procedures for this.

Home Owner's Insurance Claim Check?

I due filed an insurance claim for my home. The invoices for the major work went straight to the insurance delegate. My claim was for water damage and plumbing. The insurance adjuster just contacted me and stated how much the claim was for and that he would be sending out a check to cap damages, as well as the list of claims etc. Will he also send the invoices of the work that was done, because companies reported to my insurance adjuster. Will I be paying the presence from the check we receive. Now i am wondering if this was a normal process.


Answer: You should ask the Contractors for copies of the invoices and what calling exactly they did.

The insurance company has to pay you but I'll bet the check w ill be made out to you and the Contractor both. You'll be expected to endorse it and send it to the Contractor.

Don't send it to them until you are unqualifiedly satisfied with their work. It's often the only way to get them to come back and fix something if it is needed.
