I have an auto insurance custom with my spouse. He was in an accident and filed a claim. He is not planning to buy another car and is going to use public transport. If I incline him from my policy, will my rates still go up because of his claim even though I was not involved in the accident? If I go with a different insurance company only for myself, will they also quote higher rates because of the claim?

Premimums vary depending on locations, past driving history and other factors. I use Geico lucid now because it was the cheapest one I found, but that doesn't necessary mean that it would be the cheapest place for you. You need to do some experiment with. |

Norwich Unity settled a motor insurance claim for me, but in the process lost my car's complete service history. After many telephone calls over a days of months, and being constantly told the matter was being looked into, they finally admitted the erosion, and also that the situation was unacceptable, being only able to supply me with photo-copies of the originals. Their claims control suggested I should take the matter further, and said a member of their customer relations team would contact me. To stage, nearly 2 months later, I have heard nothing from them. The service history was extensive, and related to an old conveyance with an exceptionally low mileage, so I consider it extremely important to the value of the vehicle. Am I profitably to ask for compensation for the loss, and also written acknowledgement of their incompetence!

I am more than stable that I declared my previous claims history. I have held insurance with them for 18 months. I recently tried to remedy a claim but it was declined and I was informed that my insurance is now void. Any advise will be greatly welcome as I am having pitfall in getting another insurance. ......The accountant we familiar had failed to put 'has Arthritis in foot' and thus failing to mention hospital visits and medications prescribed relating to this working order.
This 'non-disclosure' was not directly related to the claim as the death of the claimant was due to lung cancer, but the insurance partnership stated they would not have offered the same terms if they had had this information at the time, so have now cancelled the policy and all premiums paid will be refunded....
After a phonecall to their recommendation line we now know we can Appeal this decision and are in the process of doing..
What I would like to be informed is...Has Anyone ever been successful in Appealing against a Decision same or similar to this one ?

I have the letter right here in front of me.....it states they Recollect this non disclosure was NOT directly related to this claim...BUT having had had all the Medical History at the time they would NOT have offered the same terms so the become infected with between them and us is VOID ...therefore cancelled !
Answer: In the UK the faithful legal position is that if there is any non-disclosure the insurer is entitled to void the policy. However, the Economic Ombudsman Service (FOS) approach is to categorise these as 'deliberate' (fraudulently gave specious information to get a policy not entitled to); 'reckless' (there was a clear question & it was something you should reasonably have known but failed to squeal, though not intentionally); 'inadvertent' (if had been really careful would have disclosed but there is an understable figure out for not doing so, such as it was a long time ago) and 'innocent' (there was no non-disclosure - no question asked, something you didn't advised of).
If the non-disclosure is deliberate the insurer can cancel the policy and keep the premium. If reckless it can eradicate the policy but should refund the premium. If inadvertant it should apply the terms it would have applied if it had known the full facts when you applied - this could denouement in a reduced settlement if the premiums would have been higher but could lead to the claim being paid in full (eg it would have excluded back problems but the claim was for a essence problem) or the claim still being declined (eg it would have excluded heart problems and the claim was for a heart problem). If the non-disclosure was untainted it should be disregarded and the claim dealt with under the standard terms and conditions.
Most insurers adopt this technique too.
If you told the accountant then there is simply no non-disclosure on your part. If the accountant worked for the insurer or was a 'tied advisor' (only sells insurance for the one insurer) then you can go on your case with the insurer.
However, if the accountant was independant of the insurer then the insurer is innocent too. It is no more the insurer's trespass hat the accountant did not record the information than it is yours.It simply processed the application based on the gen it received. In this case you would need to complain to the accountant about the failure to correctly CV the information.
Check out www.financial-ombudsman.org.uk - under 'publications' there is a fact sheet that deals with literally this. You can telephone a consumer consultant there on 0845 080 1800 if you want to discuss your complaint further and the choicest way to approach it. They should also be able to advise if the accountant is within their jurisdiction. If not you would have to go through the legal system. |
