I am living in Sydney.. i had full encyclopaedic insurance and the insurance company wont pay my claim i wasnt driving and i had cover for other people... Who can i touch to get help besides a solicitor.
Answer: Well, you could stick directly to the court for a judicial summary of the contractual agreement. In other words, you close the court to determine the legitamacy of your claim. It will cost less without an attorney; although, it may come to light that you have authorized basis for obtaining legal counsel later on.
What you would ask of the court is to review the contractual treaty entered into for insurance...provide proof of payment for said coverage; a copy of the mishap report; affidavits signed by those involved directly in the mishap (if possible) attesting to the events that led to your have need of of filing a claim against your insurance policy... and ask the court to validate the strength of the contract by study and commentary. If the court finds that your contract is valid and your claim is within the parameters of the agreement, they could well-organized prompt payment pending further legal actions as a civil action or by any means criminal action if their order is not honored...it is known as 'contempt of a court form' if duly issued and served to the company in question.

Answer: you do not claim if this is your insurance company or a 3rd party if 2 vehicles involved and not at fault.
for your car; both companies pay to either repair your car or the value of your car pre-fortuity. if totaled, they pay Actual Cash Value (ACV). So say you have a car loan of $5K and your car's ACV is $4K, that is all they can pay and you would owe your lien holder $1K equalize on your loan.
If it is your own insurance, they will deduct your deductible for repairs or totaled.
The insurance always pays what they owe; no more, no less. If a repair workshop says your car can be repaired for $1,500, they they pay $1,500; if on your policy, they will pay $1K if you have a $500 deductible.
If you have rental, they will pay for this per your principles while in the shop for repairs or if your car is un-drivable until they either repair or settle if your car is totaled. |

How Do You Find And Buy Insurance Companies Claim Return Merchandise ? |

I am a consumer interested in getting access to claims merchandise that have been returned to insurance companies that are to be sold off, are overdose, damaged, refurbished etc. Does anyone know how to go about getting on auction lists, bid lists, or how to be alerted of claims of trade being sold. Answer: You go exactly to the insurance companies, and tell them you want to bid on lots.
But be prepared, you can't pick and choose! You get IT ALL, like it or not, and you'll have to sell d do away with of the "junk" that you can't resell.
You'll also likely need a performance and payment union, so be sure you're bondable. That's so you don't get called to buy a lot, and then back out. |

I've been embroiled with in an accident and the other person agreed to reimburse the entire expenses. I know the individual before the accident happened. I called the insurance agent to withdraw the claim and the insurance agent is saying that it is not imaginable to withdraw a claim once it is filed. Is that true?
Answer: ...and if you DON'T cancel the claim, be sure to NOT collect anything from the other person.....you can REALLY get into hot water by doing that!
Fair call the claims department and NOT your agent in this instance!

What Happens To Someone Who Files A False Insurance Claim? |

I was with a playmate who got in a very minor accident (everyone was fine). No police report was filed, but the other driver made a claim to her insurance callers that she had serious medical problems as result of the accident (she had a handicap sticker in her car so we knew she had existing medical issues).
My beau's insurance company denied the claim since a third car was at fault (and they knew from the damage that her "injuries" weren't from the misadventure). What's the likelihood the insurance company will do anything to that lady for making a false claim? Or can people just claim whatever they appetite to try to get away with it?
We were all stopped waiting at a light and the car behind us bumped us (which caused us to bump her). Not even 5 mph, and her car didn't even move six inches. I'm 100% persuaded she was not injured in any way.
It just surprises me that if someone obviously makes a claim with the intent to commit subterfuge that the insurance company would let it go. The ins company wasted a lot of money on a mechanic and a claims person to look into this (only to find out it is was a false claim).
Why wouldn't you raise someone's premium for costing you so much money?
Answer: There is no stand, in the eyes of the insurance company, that this is a false claim. The other party would have to provide proof that she was injured and that the impairment was a result of the accident. If she does that, then it's not a false claim. I understand that when you're in an accident and you see people there at the tantrum and emotions are running high and then you find out she claimed injuries that the first thing you go to is that it's being made up. That's up to the insurance company to act on.
She could send in her medical records and they could support that she was injured, but a determination could be made that the injury is not a end result of the accident. In that case, they don't call the cops and have the person arrested. They just tell her that she didn't uphold her case and that's sometimes the end of it.
Fraud is something totally different, and those cases, if proven, are prosecuted. |

I am inferior to know how much time one has to file an insurance claim after damage has occured. For instance, your house gets hit by a tornado but your in a coma and dont disappoint a amount to out until a year later. This is not my case. Just trying to make question unclog. Is there a time limit on how long you have to file an insurance claim after damage occurs?
Answer: There's no "set in stone" wear the crown. Theoretically, you can file a claim five years after the incident. THERE IS NO LEGAL TIME LIMIT. Well, that's on a homeowners method. For liability policies and med malpractice, it's different.
The problem is, the longer you wait, the harder it is to turn out the damage was from the claimed incident, and unless you're just coming out of a coma, you lack a pretty darned good explanation.
Real life example: I had a customer put in a claim for missing scheduled silver, a year and a half after they moved - claiming it was missing in passing from the move. She hadn't done a complete inventory, and when she finally got around to it, discovered the missing silver. The claim was paid ($6,000 rudely). |

I bought a tempered to car a few months ago that had a near flawless finish. Over the past few months it's been scratched several times by my nephew on his bike. We've talked and now I needfulness to file a claim with my insurance. The marks are everywhere, back of the trunk, right rear quarter panel, hood, Nautical port rear quarter panel.
The problem is, before I knew I could claim damages, I used a start up kit to cover the scratches and gouges so they are hard to see. But I could still take pictures of them as they stand now and probably get a sign from the salesman, proclaiming the condition that he told it to me in. What else do I need to file a claim with Auto Owners? Yes, I have full coverage, including broad.
| Answer: I would resolve out of pocket or pay for this yourself, each one of these scratches is a separate occurrence... which means for each scratch before your insurance will pay anything you have to pay your deductible for broad/other that collision coverage. Typically this is $500 or so for each scratch... in the end your only going to end up with a higher store and nothing from your insurance company to show for it. |

My friends leased car was stolen, the big apple called to tell him it was recovered but they had destroyed it already. Now the insurance company refuses to pay the claim and the dealer is after him for the scratch. Him suing the insurance company is a joke as they have unending finances. Is subrogation an option for the shopkeeper to sue the insurance company or any other option available?

They gave a reason, why they didn't pay the claim. You can file a complaint in editorial, with the state insurance commissioner, to see if they can overturn the denial reason. Insurance is contract - so the WHY they won't pay, is crucial.
The metropolis destroying the car, is not relevant.
Yes, he still owes the owner of the car, for the money. Subrogation, means "cart your right to recovery to someone else". Sure he can transfer the right to meet from the insurance company, but LIKELY, the insurance company doesn't OWE him any money for this, depending on why they cancelled.

I had a new patio mask installed on my screen room. It has leaked four times already (with every rain). The followers has been out three times already to attempt to repair it with no avail. It is leaking bad. It floods the floor of my dwell and I have lost some stuff that I had to throw out from getting wet. Also, the compnay split my fascia upon installing and put caulking all over my kind new roof. Since, they can't fix it, I did not know if I should call my insurance company to file a claim because I obviously need a new cover. I perfectly paid $4800 for this one a little under three months ago. I have photos and was planning on sending a certified letter for letter to the company demanding they fix it this time or I will contact the BBB and take legal action. I am just uneasy that this will make them mad and they won't come out to fix it.
