What Laws If Any Must Car Insurance Companies Follow When Responding To A Claim? |
Jan 18, 2008 by JAMES | Posted in Insurance & Registration
It seems that the only cure if an insurance claim in Ontario cannot be resolved is to take the issue to court. The average driver may not be aware of any legislation that may constraint insurance companies to meet certain deadlines.
Each insurance retinue has their own method and time frame of responding to claims.
However, they cannot be less than the standards of the State's legitimate statutes the policy was sold in.
Most states have their insurance legal statutes available online in which you will need to look in the chapter for Insurance. If you are overwhelmed by determining the guidelines, your agent listed on your programme should be more than aware what are the rules and regulations.
Most State's allow claims adjustments to be appealable if their is a strife between policy holder and insurance company. Although, there are specific processes for it and again, referring back to that State's authorized guidelines would be needed
If you have no agent to refer to then look for a toll free slew of your State's Department of Insurance hotline consumer services. Those reps should be abreast of all the details of insurance laws for the Delineate
Good luck!

Are There Any Laws Pertaining To An Insurance Claim / Settlement And Depreciation? |
Dec 25, 2007 by power03stroke | Posted in Insurance & Registration
If a car is totaled four months ago and you received a working-out today (its current value)... do insurance companies consider the depreciated value of the automobile? Since it was enmeshed with in an accident four months ago? I know cars can depreciate up to 20%/year. Is there any laws / rights to this??
Depends on what shape you are in. However the value will not depreciate from the date of accident til 4 months later when the offer is made.

Anyone Know The California Auto Insurance Laws Well, And Can Claim Other Insurance Without Collusion Coverage? |
Mar 23, 2006 by accheung24 | Posted in Law & Ethics
My car was hit by a lush and hit-n-run driver. Although I have the police report with proof, the other insurance said they have to contact the insured first in procedure to determine whether to accept/deny my claim. This insurance company said the insured did not contact them and very conveniently do not have its insured's phone platoon. I personally found the insured's phone number and contacted him, and he told me he contacted his insurance already. The insurance ensemble said he didn't, and will try to contact him with the number I gave to them. But the insurance company also said when they contacted the insured, they will come to a decision whether his policy was effective or not. Help! It's been a month and I haven't fixed my car yet. My insurance is not doing anything because I don't have collusion coverage.
Not having your own insurance to go after the other drivers insurance is always profound. You may need to hire an insurance lawyer. If you have the police report that states the other driver was at accountable, then you are in the right. It sounds like the other driver has a shady insurance company. Probably one of those last inadvertently b perhaps places that will insure anybody. His insurance should have repaired your car by now. Have you told the insurance company that you have the police dispatch? If you have, and they have not responded to you, you need to obtain the services of a lawyer right away. You can always involve your legal fees in the settlement with the insurance company.

After An Accident Do You Have To File An Insurance Claim With Both Companies? |
Feb 04, 2008 by 50 / 50 | Posted in Insurance & Registration
Is it indispensable or required by law that a claim needs to be filed for both insurance policies.
You should communiqu all accidents to your insurance company. Even if you think you are not at fault, the other guy may try to pursue a claim against your policy. Your insurance company would suspect you as to why you did not report the loss. An early investigation into the details of the accident is critical should the other guy try to space a claim against you. Just because they make a claim does not mean your insurance company will pay anything.
You can make a direct claim against the other man's liability coverage if you so chose. There is no law which governs claims reporting by a third party.

Is there a style I'd use or do I just send a letter to the insurance companys' law firm? If so, what should be included in the letter? Lastly, am I authoritative for contacting and selecting the arbitrator?
Arbitration is exceptional in every state. Check your local authority.

Motor Vehicle Insurance Claim Under Indian Law? |
Mar 29, 2007 by Taknev | Posted in Insurance & Registration
My friend recently i.e., about 3 months, bought a TATA Indica 2005 facsimile car second hand. He got the registration transfered into his his name but did not intimate the change of ownership to the Insurance enterprise. Today the car that was kept under thached shed reduced to metal skeleton due to fire serendipity. My question is since the insurance policy as on today is still standing in the name of previous owner... will non-intimation of transformation of ownership affect my friends chance of claiming insurance? are there any decided case laws on this side? Pls. Help with advices.
hi dear Mr. unknown what you say is true only in case of third party snag not to own damages - in my friends case the company refused to cover damages for the non-compliance of intimation of alter of ownership.
whoever holds the caption of the car is the owner of the car. The insurance should be changed to the owner's name. Once a car is sold to another person insurance under the previous owner stops (even if they never determine their insurance company).

Is There A Time Limit In Reporting An Insurance Claim By Law Toyour Insurer?? |
Jun 30, 2007 by jonrossington | Posted in Insurance
Is there a particular time limit to which you need to obide to when reporting a Stolen Van claim to your insurer, by law??
The scheme states that you need to report this as soon as responsibly possible. In general, there is no set epoch frame. However, courts have held that if your delay in reporting this causes the insurance company wrongdoing by not being able to properly investigate the claim, they can deny coverage. And the longer you wait to account it without a good reason, the more likely the company will suspect fraud.

hi thanx for reading this i call some advice, I am just back from a holiday to Florida with my partner kids and mother in-law. The indulge in law paid for the holiday and took out all the relevant insurance and so on, ok, so on the way there we had 3 different flights to get which ended up with us getting to florida minus one of our suitcases, decent happened to be the one that held ALL the clothes for our 3 kids!!!! So me and my partner had to go and spend a slight feel embarrassed fortune buying clothes as they had nothing to wear, the case was delivered to the hotel later that week but we still had to buy the clothes, then on the way back we have obsolete all 6 of our suitcases that the airline says will be delivered to us soon, but my question is assuming that we get all our cases back do we still have a claim for the extinct case on the way there? and can we claim even though we never took out the policy but we are all named?

Assert: Oklahoma
This can be any type of insurance. Specifically auto insurance claims.
Here is a catalogue of hits under Oklahoma statutes. Why can't states make it easy to search their statutes? At least at Bulk.gov, you can get to page that lets you search just the statutes, without all this nonsense about reports and proposed amendments.
