Are There Any Laws Pertaining To An Insurance Claim / Settlement And Depreciation? |

If a car is totaled four months ago and you received a settlement today (its simultaneous value)... do insurance companies consider the depreciated value of the automobile? Since it was active in an accident four months ago? I know cars can depreciate up to 20%/year. Is there any laws / rights to this??

Hey Guys,
I was in a car calamity November 18th of last year. I hired an attorney in January and I have a good case. It seems like it's charming forever for me to get the money that is rightfully mine. How long do these kind of cases last and when should I expect my claim to be settled? I prerequisite the money now so I can start my life. Is there any way to speed up the process and also, could I get loans from my lawyer if he KNOWS I am getting a big settlement? He says he's straight waiting for Geico to settle. I am really growing impatient and I need the well-heeled ASAP.

It's being settled outside of court. He says the claim is now up to 30k. Also, my attorney said that he's faxed them a dispatch and he's waiting on their response. I think that's about as far as it is right now. We're just waiting for the insurance company (Geico) to sort out... how long do these guys take!?
Answer: Any stretch you hire an attorney the claims settlement process takes a longer. Instead of you talking soon to the insurance company - the insurance company talks to the attny - the attny talks to you - the attny gets back to the insurance fellowship and so forth. Kinda like the kids game "telephone".
Your attny should have explained the organize to you - but here goes: Once you are completed with all your medical treatment and have been released from the dr - your attny's office will fraternity copies of your medical bills/records. This can easily take 6 weeks to get in. I've had some dr offices take 6 months to get records to me but 6 weeks seems to be an mediocre in my area. The more treatment - the more providers- the more records to gather - the longer it takes.
Once the records are in - the attny berth will put together a demand package. This includes photos, police report, medical bills/records and attny note/demand. How long this takes depends on how busy your attny is. I've called some attny offices looking for the carton tell me that they have gotten the records in and are putting the package together and I'll get it in the "near subsequent". 2 months later - I still don't have it.
Once the package goes out - it is sent to the adjuster to commentary. Again, depending on the size of the package and how busy the adjuster is - it can easily take 1 month for the adjuster to re-examination the package and get back to the attny with an offer.
If there is information missing from the package -the adjuster will call the attny and insist on the missing information. The process starts again.
Once the adjuster has reviewed a completed enclose and no information is missing - negotiations begin. At some point, the attny will get with you about the insurance company suggest - and then get back with the adjuster. How long this takes depends on you and your attny.
Once a settlement is reached, the adjuster will send a settlement discover and release to your attny. The attny will usually deposit the check into a trust account and have you colophon the release. He will return the release to the insurance company. At this point - the insurance company will close their documentation.
Now, your attny will talk to the medical providers and try to get them to reduce their medical liens. The settlement constraint has to pay 3 things 1. your medical bills, 2. your attny for his services, 3 whats Nautical port goes to you.

Some attnys or their clients get the bright idea to file a lawsuit - thoughtful that will make the insurance company get out the magic pen and things go faster. Not the case. All a law suit does is invoke occasion the above process to a screeching halt. Now before you even get to the above steps your going to have to go through discovery. Law suits as a rule take 2-5 years to be resolved.
Also - insurance companies are NOT threatened by lawsuits. We deal with them and attnys all the formerly. So an attny sending me a letter threatening to sue me - means a whole lot of nothing and is obnoxious.
So -- big story short - this is a claim - not a lottery - it ain't fast money. If you need money to "get on with my time" - get a job. |

"this letter is to confirm our offer of 10,200.00 in settlement of your clients claims against our insured for the above misadventure "
what does it mean?

I had an mischance with a table saw resulting in the amputation of several fingers. I did not have health insurance at the time. I sued the proprietor of the table saw and received a settlement through their homeowner's insurance. Are the medical expenses deductible?
Answer: Not unless your medical expenses exceeded what you received in the settlement. You could only withdraw the amount of the excess expenses that exceeds 7.5% of your income on 1040 line 38.

How Can I Get The Best Possible Insurance Claim Settlement? |

There was a fire in the apace above mine and subsequently my flat has fire/ smoke damage to the ceilings and walls. In the kitchen some of my units have melted too and I have had to move out and block with friends whilst my insurance company assesses the damage and so on.
However, the insurance company have come back with an monogram settlement, and having got quotes for the work, the amount is not going to cover the repairs. I think that the insurance establishment think that a lick of paint is going to fix everything. Anyway, I have gone back to them and said that this is not an acceptable amount and they are 'reflective about it'.
What I want to know - is what else I can do!! HELP.
Answer: Not unshakable about those other links (cough) but these guys are pretty recommended and are more likely to get you a good settlement - as they are nobility at haggling with insurance companies.
Basically, loss assessors work for you and not the insurance company to make sure that you get what you are entitled to. |

Poser is, I don't have any proof of having given them the original bills (mother's operation that incurred a set someone back of over Rs1 lakh). I now only have photocopies of the bills. Can I get an affidavit done that will make it possible for me to use them in lieu of the originals? Is the medical insurance guests legally bound to accept this affidavit?

So in February 2009 a girlfriend reversed into my car, I have paid £500 for the damages myself as it takes to long for the third party's insurers to condition the damages, and now I have legal aid from my insurance company and they are chasing the third party insurers for my money back. The third celebration hasn't admitted liability, but I have a witness just not an independant one.
It seems to be taking a fancy time for any kind of update from the third party insurers, and my insurance company doesn't seem that interested in chasing them up unless I ask them to.
How can I get my come what may settled more quicker?
Anyone know about the processes of these claims and how long ti can take?

About a month a go, my helpmeet and myself were rear ended at a signal light, we were not at fault. My wife was 5 months pregnate with twins at the continuously of the accident. I drove her to the ER to make sure everything was fine with her and the babies. Thanks God everything was comely. It was kind of scary. The persons at fault insurance wants to give me $150 for loss of wages and 250 for the untimeliness. For my wife the are offering $500 for the inconvenience plus any loss of wages.
My query is, is this fair or not?
I live in Texas.
The insurance will also pay about $2,300 on medical bills, $1,250 for car repairs and about $250 for a rental conveyance.
Answer: I invent it's low, especially for the babies. If they haven't been born yet, you should be able to settle before they are born for $1,000 each, against potency pre-birth injuries.
Tell the adjuster, yes, likely they are fine, however, if something DOES soften the sound of a go to bed out to be wrong, we all know we're looking at a policy limit settlement in court. So $1,000 per babe is them getting off At. |
