What Happens In A No-fault Auto Insurance Claim? |

I was implicated in a minor accident recently. I claimed it was the other party's fault. The other party claimed it was my fault. The the fuzz report assigned no fault to either party...
What happens if my insurance company also does not assign fault to either driver? Does this sour that my insurance will not have to pay for the other's damages?
I live in NY
confide in me, someone will be assigned fault.

On An Insurance Claim That I Am Partially At Fault, Is It Better To Turn In All Of The Estimates & Med Bills? |

I was in an automobile accessary. Both parties were at fault. Insurance companies handling most of it, they're still debating percentages. Should I turn in all estimates on the car & all medical bills. Or should I honest let my medical Ins cover the DR & hospital?

Always find everything in. Why?
1.
If you have medical payment (usually called MedPay) on your auto insurance policy - it doesn't make a difference who is at fault. That is a first party coverage you are entitled to (if you pay for it).
2.
When it comes to a BODILY INJURY claim....Depending on the indifference jurisdiction of the state you are in.....and the percentage of fault you are assessed - you may or may not be able to claim any of your expenses.
What you are not accomplished to claim...or have covered under your medpay coverage (if applicable) you can THEN present under your health care coverage.
IF you are entitled to some coverage anywhere else (Medpay or BI) your form care carrier will be entitled to RECOVERY from the at fault carrier. If you don't tell them and they find out (by reading your medical notes) - they will send you a deliverance (or subrogation) letter to get the information on the at fault carrier.
Now - if you submitted everything like I said above - you will have documentation from the insurance companies about what is and is not covered. You can forearm that information to your health care carrier. If you've EXHAUSTED coverage available under the MedPay (discussed to specific limits) and/or BI coverage - your health carrier will become primary and have to pay the differences.
BTW - there are no deductibles for Med Pay coverage.

How Can You Prevent At Fault Insurance Party From Delaying Claim? |

Any par on fighting the at fault party insurance company from delaying claim. How long after accident do they have to settle claim? Any guidance to speed up process?
There honestly is no time limit. The other party's insurance company has a procedure they must follow. First thing they have to do is to get hold of their customer to verify the facts of the accident. They have 30 days by law to do that. If, after 30 days they have not been expert to make contact with their customer, they have the right to deny the claim. In some cases, they may use the police communiqu to verify the loss facts and pay, once the 30 days have passed. In the meantime, you also have a stability to mitigate your damages, meaning that you have to protect your vehicle from becoming further damaged, and to file a claim with your own insurance assembly. If you have the appropriate coverages, you are required by law to make a claim with your own insurance company, and the other company can be billed for the damages. If you don't do quite everything to take care of the damages in a timely manner, the other company is under no obligation to pay you for your loss.

i was a uninspired who got hit by a mailtruck. i have to go through my sisters insurance because i have none as a resident relative to file a claim. screwed up, i know. this is a michigan no fault claim. however my sister has had two claims in the before 3 years already with her insurance. will this additional claim cause her insurance to go up even though it is a no fault.?
more than reasonable, but why is it no fault? unless you were jaywalking the driver would have 100% fault

No Fault Insurance Claim Wanting To Claim $20/day? |

Could anyone counsel me in the right direction in this situation. My daughter and I were involved in a car accident where the other party was at fault. We were both not Scout's honour injured, but I was pregnant at the time and my daughter has been disfigured slightly on her nose(has looks of a boxer's nose).
I know that I am entitled to $20/day on replacement services but my insurance train is asking for proof. ie: names and dates of those who provided service, and also the ammount that I paid for these services. They also hankering a letter from my doc stating I couldnt perform these activities. ie: picking up over 5lbs, moving around, etc. All of these things I am proficient to provide, but I was told by my ins company that I could only claim for myslef and not my daughter, and couldnt claim over the period that my doctor has issued my infirmity.
An attorney I spoke to said that I should be able to claim for myself and her, plus be able to claim the limit of outdated which is 3 years. Could someone please give me some guidance if at all possible before I get screwed like many others do with insurance claims?

I have in front of me a letter from my ins company stating that I have 1 yr from the date of the accident to establish f get on the PID claim($20/day), and they will pay $20/day up to 3 yrs. But they are claiming that my daughter cannot be in that claim since she is not a caretaker and just a child. And I did not employ any lawyers, just called around to see what their input was. And it is my ins trying to screw us over.

Extended Period Courtesy Car On Non Fault Insurance Claim? |

My car was hit by another driver and the accessary was not my fault.
My insurance company Norwich Union (dont ever use them they have been a complete hindrance to the process, even if they are cheaper the filthy lucre is soon lost again) will only provide a car for 2 weeks. I know i could rent and claim back but being 20 i cannot farm out a car in the uk. I know there has been case law about this situation ( http://business.timesonline.co.uk/tol/bu siness/law/reports/article2673594.ece ) and legally i should be provided with a car farm mine is repaired, but i am having no luck with the useless indian call centres of Norwich Mixture they are just passing me from one person to the other and putting me on hold. anyone have any ideas?

menace to take them to court usually they will quit....this happened to me in october! which i ended up renting out of my purloin spending about 700 dollars and i'm still waiting on my settlement! good luck and i be sure how stressful it is but dont give up! go for pain and suffering to!

( Premises answerability)There are about $ 20,000 in medical bills. Will the health insurance co file a lien against the at fault party's insurance companions or will they have a right to my settlement. Also, the at fault party has $ 5000 in med pay coverage. Would my health insurance be superior to file a claim against that? My health insurance co - bcbs has been VERY uncoopertive in explaining this to me. Thank you.
They will have a high-mindedness to your settlement, under the "transfer of rights of recovery" section.
Yes, they can subjoin the medical payments amount, OR any liability payment amount, up to how much they paid out.

While driving in a Arcadian area at dusk, I suddenly see something in front of me and I have to swerve to miss it. It is a flatbed truck that had pulled into a driveway but some impose upon overhanging the bed was left sticking out in the road across half of my lane. The lumber struck and scraped down the unscathed passenger side of the car. Who is to blame: me for not seeing it soon enough pr the other driver who left the wood sticking out in the avenue while he "checked the mailbox"?
The junk, even if he did have his lights on he should be yielding to ongoing traffic.

I had an accessory on June 10 tha was totally my fault. My insurance said that will cover the value of my car plus up to 2,500.00 in medical bills and or wages gone by the board due to the accident unabling me to work.
Can I still claim compensation due to the pain and discomfort I been through? My insurance is Farmers.
You cant rank a claim against your own insurance company for pain and suffering. This would come in the form of a lawsuit. You cant sue your own insurance company for suffering and suffering when you caused the accident. You would be suing yourself.

The New York Land Insurance Department is proposing new regulations for no-fault auto insurance coverage in Empire State, in a move the declare’s top regulator says will help reduce fraud. “We have to be observant in protecting the pocketbooks of consumers,” said Superintendent James J. Wrynn. “New Yorkers should not have to pay a phony and abuse tax in their auto insurance premiums. The cost of each no-fault claim has gone up by more than half in the past five years, and all New Yorkers with auto insurance are paying that tab.
