Who Is Ultimately Responsible To Pay On A Property Insurance Claim?

During the method of repairing our home, after a fire, some of our personal property was damaged by various sub contractors and the fire department.

We have replacement value property insurance.

Who is legaly chief to cover those damages? My insurance company or the company/person/dept. that caused the damage? What if I don't be familiar with? What if they won't pay?

Answer: Can't sue the fire be influenced. Property gets damaged when they have to put out the fire to keep the whole house from burning down. Do you really want them to move very slowly and trouble about not entering the window b/c they could break your lamp? Or would you just rather they get in their and put the fire out. Not to mention, the water they use to put the fire out causes a whole sort of damage. The fire department damage would be covered under the homeowners claim that pays for the damage directly caused by the fire.

What did the sub's damage? You can speak with
the contractor who is doing the repairs about that.

However, since we don't identify what property you say was damaged, there is limited help we can provide here.

Is There A Time Frame For An Insurance Company To Settle A Claim On Property Damage That They Are Liable For?



Answer: Unspecifically speaking they have 30 days from notice of claim to investigate the loss. If additional at the same time is needed it is extended an additional 30 days and they tell you what they need to conclude the questioning (scene photos, witness statement, driver statement, recon, etc). Upon documentation of loss they have 10-20 day to pay or deny, but if the investigation is not complete they will not pay. Once the investigation is complete and impediment determined, the claim is either paid in ful or part, or denied.

THIS is why you are told to mitigate your damage(s), THIS is why you go through your own insurance for your damages.

Public Liabilty Insurance Claim To Damaged Property?please Advise?

Hi,
I got a catch testing ports at a big computer firm. They insisted I had public liability insurance and employees indebtedness.
I duely got back policies.

On the 1st day of the job we damaged an expensive piece of testing equipment.

Do I claim against the community liabilty insurance? am I in fact even covered?

Answer: You will want to check with your insurers, it will depend on what has happened and who the test equipment belongs to. If it belongs to your patron it is likely to be covered, however there may be an exclusion on your policy, relating to damage to property you are working on.

Can I Claim Property Damage To My Car If I Didn't Had Insurance.? It Was The Other Driver Fault.?


This chance in new jersey. The driver with the insurance ran the stop sign and she was found at fault. Now I don't have insurance, I'm trying to claim my property damage through her insurance. Now my lawyer tolded me I don't have the in a beeline to sue but I have the right to claim the property damage to my car? is that right?


Answer: if you breathe in Arkansas, you are out of luck; they will not allow you to claim because you should not have been on the road. You may put in a claim, but they may decline to pay, as all states require some trim of insurance or an equivalent amount in an escrow account. I assume you were cited for failure to exibit validation of insurance also. If you have the police report, you may need to fax it to the company.

I Have A Car Property Damage Claim And Have Lost The Title To My Car. What Can I Do?

I'm assumed to sign over the title to my vehicle in order to receive compensation for my vehicle waste, but I have lost the title to my car. Besides replacing my title through a title agency what can I do? Is there perhaps a form that I can fill out with the insurance South African private limited company without having to send for a new title?


Answer: It depends on how the old the car is. If it is older than 10 years you can honourable write them a bill of sale. The local DMV probably has forms for that. If it is newer than 10 years you will have to do an odometer disclosure and that has to be done on the ownership. You would want to go directly through the DMV to order a replacement title, not some third party. Most states have an despatch title process if the vehicle is in process of changing ownership and you have to comply with federal odometer laws. Sign in with your local DMV to see what their processes are.

Sometimes you can give power of attorney for the vehicle only to the insurance company when they give you the payment and then they assign for the title and sign off for you. You should check on that too.

Water Damage Insurance Claim Payouts?

Can ayone relate me how much the uk insurance companies paid out to their policy holders for water damage to their property in 2005 or 2006. This will cope with to damaged caused by taps left on, faulty plumbing, burst pipes etc. NOT RIVERS BURSTING THEIR BANKS ETC.

I would also like if imaginable to find out what percentage of people have experienced such damage in the last five years.Also the average cost to put the damage right.. and the apogee payout for such damage on any one claim. Thanks bill saint


Answer: To all intents not. For the most part, that's proprietary information, and although it might be shared with other insurance companies, the exact numbers are not affluent to be "public record" as broken down by claims.

Your best bet is to talk to your own advocate, see what YOUR insurance company paid out, and assume it's industry average for your area.

Maximum payout is universal to be limited by each policy - that's an IMPOSSIBLE number.

Answer: If you are contemporary third party(against the other driver), you may be entitled to the Diminished Value, if the vehicle is not totaled. However, you have to do the leg trade. The insurance company will not attempt to prove the DV for you.

If the vehicle is totaled, you will receive the Actual Exchange Value(replacement minus depriciation). The insurance company does not use any record. They use sources like CCC.

Make sure the claims rep has all of the options, the correct mileage and find out what inure they ran it through as, Excellent, Good, Fair or Poor.

Edit - contrary to what the other posted suggested, you cannot sue the insurance institution. You would file suit against the driver/owner of the other vehicle. However, you will probably not have to sue anybody. The insurance convention will offer you the ACV which is a fair and reasonable settlement.

Why Do Insurance Companies Check A Homeowner's FICO Score Before Adjusting His/her Claim For Property Damage.



Answer: There's NO Defence, IMO, to check a FICO score as part of a property damage claim.

The only reason to check it, during the claims process, is if you've got an arson or swiping case that you think is fraudulent, and you're considering evidence for bringing fraud charges against the insured. I can't consider of ANY OTHER reason why it's relevant.

It is part of the underwriting process, so an underwriter can check it before renewal, or before editorial the policy in the first place. But I don't have any clue why an adjuster would check it, if it's PROPERTY DAMAGE.

Texas A Vehicle W/ Insurance Coverage Is Stolen And Wrecked Causing Property Damage Who's Responsible To Pay?

I flaming in Texas and a neighbors vehicle is stolen and the reported thief wrecks into my metal woodwind fence causing estimated $1500 in property damages. The vehicle has full coverage insurance. Who's honest to pay? I filed a claim with their insurance and claim was denied.
So with no one having permission to drive the vehicle then would there not HAVE to be a theft piece to match substantiate to some degree?


Answer: Well of orbit the claim was denied, they didn't do it, they weren't driving! You file the claim with your homeowner insurance, and they try to collect from the car picklock, who probably has no assets anyway!
