Who Is Ultimately Responsible To Pay On A Property Insurance Claim? |

During the alter of repairing our home, after a fire, some of our personal property was damaged by various sub contractors and the fire department.
We have replacement value property insurance.
Who is legaly liable to cover those damages? My insurance company or the company/person/dept. that caused the impairment? What if I don't know? What if they won't pay?

Answer: Can't sue the fire bank on. Property gets damaged when they have to put out the fire to keep the whole house from burning down. Do you really want them to move very slowly and bother about not entering the window b/c they could break your lamp? Or would you just rather they get in their and put the fire out. Not to mention, the water they use to put the fire out causes a whole bouquet of damage. The fire department damage would be covered under the homeowners claim that pays for the damage as soon as caused by the fire.
What did the sub's damage? You can speak with
the contractor who is doing the repairs about that.
However, since we don't know what property you say was damaged, there is restricted help we can provide here. |

Property Insurance Claim - Payout Doesn't Even Come Close To Actual Repair Cost? |

Do I have any entr on a property claim when the insurance company sent out an adjustor and then simply mailed me a check? I have a $1000 deductible, and received a probe (no papers signed on my part stating that I accept this as a settlement and I have not cashed the check). The insurance correspond is for $1400. Essentially they are saying the damage can be repaired for $2400. Well, I've had several companies assess the damage and they range from $3700 to $4300. Does one have any recourse or must they accept what the insurance says they'll pay out and absorb the keep on being? I was always under the impression that your deductible is what you are "out" if you have a claim. But, looks like I'm "out" $2300, not justified my $1000 deductible. I have contacted the insurance company and am now getting the run around of course. Nobody wants to take culpability and nobody will return phone calls. TN Farm Bureau is the company - not some fly-by-night friends, either.
I have contacted the claims department as well as my local agent. Each tells me to contact the other. It's comical. At this point, none are returning calls. The adjustor has been left countless messages - none returned. The claims executive never seems to be in and doesn't return calls. I'm getting real aggravated since I have several homes and several cars all insured through these people. They are about to admit defeat a good chunk of their business. The additional that I feel is fair to cover this claim fully is LESS than my annual premiums on all of it combined. So, they will displace a lot more than $1300 if they don't get this settled. Their choice, I guess.
The check does have (in fine publish, of course) that endorsing the check is acceptance of payment in full for the claim. No way is that check getting cashed.
Answer: Of course, you have some thinigs you need to do.
Start with calling your agent. Ask the agent to get an explanation. It's Practicable that they are taking "depreciation" until after the repairs are made, but that doesn't usually find on a claim as small as yours.
Contacting the company isn't going to get you as far as contacting the agent. But if your agent honestly won't help (then, of course, you're going to fire them), you need to call the adjuster, and explain you are getting quotes around 4K, why are they underpaying you.
If you can't get a comeback from the adjuster, you need to complain, IN WRITING, to the state insurance department, and CC the adjuster. Keep copies of everything you send!! And count the written estimates you've gotten for the work.

Should I File A Claim Against Our Property Insurance? |

Last July, our builder parked a calling truck on the street blocking our driveway and we had our landscape trailer parked IN our driveway. While it was parked there and his men were working in the driveway, somehow it rolled down the driveway and hit the barrier of the truck with the top of the trailer frame, scratching the truck's paint. The builder said, "Don't irk about it", but of course we didn't get a release signed. In December, we made a large claim against our new where it hurts warranty. Lo and behold, we just received a copy of a repair estimate for $500 for the wares, and a letter from the builder requesting payment. First of all, the estimate contains $200 of charges listed as "misc" beyond the go on a bender and labor costs. Second, it seems excessively high. We are really upset at this and are totally certain that the builder has used this as a way to recover some of the costs for our home repair and get payment. Should we file an insurance claim? Request an estimate from another shop?
Answer: Was your trailer married to your vehicle? If it was, contact your auto insurance carrier--they may extend coverage to the trailer if it was married to the auto. If not...
$500 doesn't sound excessive, but I am curious to know what the $200 MISC assert is for. You have a right to a break down of ALL the charges, and this includes MISC charges. It doesn't plunge like the work was done by a body shop, so chances are the work hasn't been done. You are entitled to scan the vehicle and pay for "reasonable" charges relating to the repairs...ask the guy if the repairs have in reality been made. If not, GO WITH HIM (or her) to the repair shop of THEIR choice and obtain an estimate.
You could file a claim with your h.o., but what is your deductible?
Also....h.o. should only be habituated to for "large loss" claims, such as fire. I wouldn't risk your h.o. rates rising because of a $500. |

If Property Is Behind On Payments, Has Been Vandelized, Can Lender File Insurance Claim And Collect Check? |

Investment property purchased for rehabbed. During rehab, mortgage was not being paid and insurance pass. Lender purchased insurance. Property was vandelized, lender filed claim and recieved check. What happens to the verify? How is it applied? What will it be used for?
Answer: The lender has to defend their investment, which is their loan. The collateral (the building) also needs to be protected. Your loan documents states what your responsibilities are, mainly as it relates to how the property is maintained and repayment of the loan. When you get the loan, you also agree to maintain insurance on the property; the lender has the licence (and obligation to their investor) to place insurance on the property should yours lapse.
The check for damages goes to them; if the mortgage has not been paid, and you are in dereliction--well, your lender did what they were supposed to to protect their investment. In the event the property goes to foreclosure, they're stuck with a vandalized edifice that they have to sell to recover their loan and expenses.
The check goes to them; as with any other insurance check, it will go toward making repairs to the property that resulted from the vandalizing. But, to be unwavering, you can contact the insurance agency that has the policy or make a written request for information from your lender. |

How Can I Make A Personal Property Insurance Claim When The Police Will Not Allow Me To File A Report? |

Two months ago, I took adverse property to an ex-friends home. He moved and his whereabouts is unknown and with him went my property. My insurance company claims that my special property is considered Covered. My insurance company has stated that in order to process a Loss, I must march a police report; the claim forms support this requirement.
Here is the problem: According to the Administer Dept., they cannot take, nor may I file, a Police Report. The Police Dept. has stated that this spot is NOT a criminal matter; it is a civil matter known as a "Breach of Belief." Also, the Police have stated that my only recourse is to sue the person who took my property when he moved. And, I remember that his act was deliberate as I tried to collect my property several times prior to his disappearance.
I have already informed my insurance assemblage the circumstances surrounding this Loss.
Since a report is required by my insurance company, how can I possibly proceed with this matter?
My insurance concern told me emphatically that my property "Off Premises" is covered unconditionally, epoch. It is the inability to file a Police Report that is holding up this entire matter; and, the Insurance Body stated that they, and myself as well, cannot make the police do what they are not going to do.

Answer: You poverty to talk to your insurance AGENT about this, and have them speak to the company on your behalf. You do have an agent right? This is where they poverty to take initiative to help you out. Have you tried the company more than one time? Sometimes you get someone taking the claim that just knows the rules, you want to find a supervisor or someone who can bypass that and turn the claim in anyway.
However, since you did let us now that it was YOU that brought the property to his house, it will more than likely not be covered under your homeowners ways as there was not THEFT.
EDIT- If your company is saying that your property "Off premises" is covered regardless of the spot then put it back on them and tell them they should take the claim without a police report. The police are telling you a crime has not been committed in which if it should happen you would not be able to file a police report, which you are finding out here. Your company is telling you your property is covered regardless, so they demand to stick by what they are saying and accept and process the claim. I would start talking to the claim supervisor and then their governor if you still do not get the answer you are looking for. This may be the only way to get this done. Get your agent involved immediately, they would be able to climb the ladder more doubtlessly than you to find someone to take this claim.

Answer: Yes you can. There are many times when a the fuzz report is not filed! In my area, if both cars can be driven, and no one is injured enough to be transported to the sanatorium by ambulance, the drivers exchange information and the police do not write a report!

| Answer: It depends on what the reasons are for the obstruct--if they are investigating, it can take awhile. Put your request in writing, with a copy to the insurance department in New Mexico, asking for a brilliant resolution. If that doesn't work, hire a public adjuster. |

| Answer: There is no trait to it. Do your research. If this is auto property damage make sure you know the value of your means. If this is a homeowners loss make sure you make a comprehensive list of what you confounded and search the net for replacement cost on the items to back up the data you give the adjuster. Make unwavering you are open and honest with them. Their job is not to give make you money but to bring you back to the position you were in prior to the sacrifice. Any kind of attempt to profit on your loss is insurance fraud so be very careful. |
