How Do I Claim My Deductible And Rental Car Insurance From Someone Without Insurance?

What is the overpower way for me to get my money back (deductible and rental car costs) from someone who caused the accident, but who's insurance turns out to not be valid? She is insured with Geico, however when I called them - they said it is plausible that there is something wrong with her policy and they will probably not cover the cost of the accident. I'm guessing she didnt pay her monthly bill, or something comparable which caused them to void her coverage. Can anyone suggest what I need to do to recover my expenses for the mischance she caused?


Answer: Legally, your shipper is abrogated to your right of recovery. As you may know, this is just for the amount that they pay. However, your carrier has as much right to _anything_ paid by the other bodily as you do. So if you collected anything from the other person, your carrier would legally be entitled to at least a portion of it.

You could let your carrier request recovery of the amount they are owed and usually this would include asking for your deductible but seldom will they ask for your rental payment. Also, it's objectionable that they will collect much of anything.

With that said, about your only recourse is to file in small claims court. This will get you a peice of daily called a judgement. It's not money... it's just a judgment. Still no guarentees you will be capable to collect. If you could/do... I'd say keep it and let you carrier find out on their own if they can. That is just my opinion.

My other recommendation is to make assured the police or at least the state knows that this person is uninsured (if GEICO confirms this). That way the solemn can suspend the person's drivers license until they pay you what she owes. If the state does not find out, she will sustain to drive and cause someone else the same loss you suffered.

Accident Insurance Claim "rental Car"?

i am in a claim because a maudlin driver hit me. I have received no check on the total loss of my vehicle yet but they are terminating my rental car. HOw is it they can do that!? They say I cant supplicate this, and that they think they are being fair. What is normal procedure...Doesnt it make sense to at least give the legatee money so they can purchase a new car rather than after the rental car is revoked? Any steps or advice? Just wanted to get a undetailed consensus on this, is this "cheapness" any indication of what to expect on the bodily hurt etc claim? Workign with this insuance agency has been like pulling teeth! and the reps have been gruff and sorely lacking on customer svc skills. How can I effectively negotiate with out this turning into an contention or a brick wall because they fall back on , it's policy....isnt there such thing as tempering circumstances? This is my first accident and I m really looking for some solid advice on how to deal with my claim. Through you so much.

Answer: There ARE rules covering how extensive a rental must be furnished. They are apparently within their rights. Do you have your own car and insurance? Why haven't you let them and their many free (to you) lawyers do the "negotiating" for you ? After all That is what we buy insurance for. If you have insurance, use it !

Travel Insurance Coverage That Includes Full Rental Car Insurance? Why Pay For Rental Car Insurance?

I excursions often but have never bought travel insurance. I always rent cars and buy the full insurance coverage from the rental. I don't own a car or any auto insurance. I am somewhat familar with non-proprietor insurance options and the claimed coverage from the credit card companies. But why buy two insurance coverage when one can pay for both?

Do you recollect of travel insurance coverage that includes rental car insurance?


Answer: You can't get Debt coverage. You have to get it from the rental car agency.

You can get a CDW if you live in the US or Canada. You have 2 choices:

1) You can get a trip cancellation map that includes a CDW. Most plans exclude OR, NY and TX residents.You have to be taking a trip with fixed junkets dates

2) You can get a stand alone CDW if you live in the US or Canada except Washington State.

Will My Uninsured Motorist Claim Pay For A Rental Car Until I My Car Is Repaired If I Live In Texas?

I recently had an disaster with an uninsured driver. My claim is an "uninsured motorist property damage" claim. I do not have "rental insurance". Is the rental expenditure covered by UIM since if the other driver had liability coverage their insurance would have covered my rental?
Rental insurance coverage is for collision and comprehenisive. I skilled in that in most states UIM will basically act like the other driver's liability insurance and cover rental cost, but I am not tried about Texas.


Answer: In Texas, if your claim is being covered under UMPD, you are entitled to disappointment of use with a rental car. Ask your claims adjuster.

Advice Fighting A Denied Insurance Claim By Visa For A Car Rental?

I was confusing in a solo-vehicle accident back in February 2008 resulting in my Hertz car being totaled. I, unfortunately, spoke to the boys in blue officer and there are probably 2 issues in the police report that are damaging: first is that I stated I was touring 50mph in a 35mph zone and secondly that I stated that I "wanted to see what it (the car) was capable of."

I had Visa's rental coverage (wreck) with the balance covered by Hertz, but because of the nature of the accident, it was up to Visa to approve/ vamoose the claim. They ended up denying the claim because "damage to the rental vehicle was a result of lack of rational care."

Now I owe Hertz the balance of the value of the car which is substantial, so I'm wondering if anyone has had be like experiences and what processes/ avenues they used to fight the denied claim.

Answer: I don't remember that you will prevail with Visa's rental coverage but you might also have coverage under your own auto insurance policy. Most auto insurance policies yield for the coverage to extend to rental cars that have been rented in the USA. Generally it will cover you to the same extent you would have been covered driving your own car. So if you have crash coverage you might be covered.

Insurance Company Pay For Rental Car While Mine Is Being Repaired?

i got backside ended, the other driver was at fault, his insurance company is paying to have my car repaired. my claim handler with his insurance troop told me they would pay for me to get a rental car while my car is in the shop being repaired. now my car is scheduled to go in the shop monday, and the claim handler wont call me back. are they the ones that constraint to set up my rental car? or do i just call a rental car place and give them the claim information, and they bill the insurance company??


Answer: You sine qua non to get your own rental car but it should be billed to his insurance company. If the specific handler won't call you back I'd call his insurance provider and ask to speak with someone else in reference to your subject and pending claims. You can also call your insurance agent for advice and help to make sure you get what's due you.

My Car Insurance Claim Is Being Sent To Arbitration, Is This Binding?

My son was in car ruins, the other driver was issued a failure to yield ticket which he paid. However the other driver said it was my sons in the extreme and his insurance company refused to pay. My insurance company paid, but I had to pay the deductible of $800 and we had to get a rental car $1400 while his car was being repaired. If the arbitration comes back and says I get anything less than $2200 back, can I still sue? This is all episode in Virginia and there were no injuries, i just want to be reimbursed. There was also a witness that said it was the other drivers indiscretion.

 
 

How Do I Make I My Insurance Company To Pay My Car Accident Bills?

superstar hit my car and did some damage to my car,i had some repair and some rental car bills my insurance company wanted me to go to certain body shop which i did not like so i went to my known league shop well the repair bills they paid only cover some of total bills which i do not be in touch with oneself decide but i had two rental bills they only paid one one $141 other $ 777even though my coverage is for 30 days they did not pay $ 777 bill . my insurance sued the other car insurance partnership and arbitrator judge in my favor the other insurance repaid to my insurance but i am still out $ 777 now none of insurance co. answer my phones for the rental bill for $ 777 in official of new york what is my option to cover rental , small claims say i can not sue insurance co can complain to NY insurance commissioner or what can i do. Answer: Well, you have a LIMIT OF COVERAGE on the rental. Most often it's $15 a day, or $25 a day. What's the limit? The policy doesn't pay for more than you bought. AND it only pays for present repair days - not the waiting time until your body shop can "get around" to doing your car.

What does your Emissary say? They're the first line of help for you. YOUR AGENT. They should be the first person you call for help and explanations.

Regarding wee claims court. Of COURSE you can file and sue. But likely you won't win, if the policy is only paying out the limits. So you're wasting your just the same from time to time & money, and risking a countersuit for the legal fees of them sending their lawyer to watch over. THAT'S probably what they mean.

On the body shop issue . . . if they have shops that do the toil for $35 an hour labor, and you choose to take your car to a shop that charges $70 per hour for labor, YOU have to pay the inequality. Again, YOUR AGENT can explain this to you.

It's HIGHLY possible that you either 1. got a more expensive car than you had coverage for 2. kept the car longer than the manifest repair days 3. added "extras" to the rental bill, such as their wreck damage waiver, etc, none of which you mentioned, none of which EITHER insurance company is responsible for.

OF COURSE you can beef to the NY insurance commissioner. Then they'll ask your insurance company for an explanation of HOW they arrived at the amoutn they paid you (and your adjuster should have already explained this to you), and if it's permitted and right, well, that will settle the complaint.

Car Insurance Claim Problem. Any Options ??

got into a foolish accident. The other driver got a qoute from body shop - it was for $600. I decided to get it done thru insurance as ostensibly in NY if the repair is under $1000 then I cannot be surcharged.

Insuranced fixed the other car. Total repair came out to $1500 + 7 days car rental. That is a BIG idiosyncrasy for a total of $1800. from the initial quote.

Where is the difference coming from? I feel as if my insurance was out to take me (GEICO). What are my options now?. How can a simple repair quoted at $600, cost unerringly 2.5 times more thru insurance which is suppose to have people working for "me" to get-up-and-go repair costs down?.

The "accident" was a big dent on a neighbor's car during soprano winds and my door swung open out of control and dented his door.
For whoever thinks I lament too much: A 2.5 times increase in repairs doesn't make sense.

The deface was only superficial from a dent. Not a moving accident. It is possible that the adjuster screwed up. That is all I am saying, after all there are bungling, negligent professionals in every career.......

Sweetie- when you got the gauge.. it was JUST THAT- an ESTIMATE. Once repairs start body shops almost ALWAYS find additional reparation. That amount of damage is VERY typical.

Many things could have happened.. they could have took off that outer skin of the door.. and found more damage inside of. Maybe they called to order a part and found out the part price increased. They dont just give out spinach for fun.. thats absolutely ridiculous. You really think theyd increase your premiums 1200 next year anyways and profit from this? ha.

So.. to surrejoinder your question.. your being absolutely ridiculous. Most people think insurance only pays bare slightest and trys to get out of stuff.. i cant believe you think the opposite. Your absolutely wrong to judge devise this and seriously why dont you just be happy they covered the damage and get on with life. geesh.

My Achates and I were driving in a rental car in California. I was the driver and it was rented under my name and on my insurance. Both of us have comprehensive insurance.
