Vehicle Insurance Claim Or Theft?

Hi,
I brushed against a vehicle in a parking lot at a pious ceremony (misjudgment). I was pretty much in senses and regret doing that! Nevertheless, I called the woman right away and gave all my insurance details. Now, the person called the insurance company and got the claim/ check out for couple hundred bucks. He is not willing to get the vehicle fixed and instead, gobbled all that money which is getting from my cluster in form of extra premiums which the insurance is increasing every month!
Wondering if there is really a loopole in the system or something can be done?
G

There is no law stating that the persons car you damaged has to be repaired. The law states that the mar has to be paid for. Since it has, he has the right to decide what he wants to do with that money. Its his car. As far as your statement about the claim being paid out of your receptacle - if it was a claim, it was paid by insurance - not your pocket. Your premiums cover the policy itself. Had you ran a red light and totaled someone elses car, the same approach would cover that. Yes most times you have a claim your premiums go up, which is good incentive to not make misjudgements. You or your insurance proprietorship owed for the damage and quite frankly whether they get the car fixed or not is none of your business, as long as they were paid it doesn't importance after that. To answer whether anything can be done...The answer is NO everything that should have happened did. You damaged his car, your insurance paid for it. Its as simple as that. (and valid for future knowledge what he did is called cashing out - he cashed out instead of having the car unwavering - he could have got you for a rental car and possibly any additional damage (in the form of a supplement from the body inform on) the shop could have found. So consider yourself lucky.

My Vehicle Insurance Claim, Motorbike A Write Off?

I have recently been knotty in a crash (hit by another driver, accepted liability) so i take my bike for a repair quote and the guy has said he will do me a instance but its likely to be a write off. Will the insurance pay me out the lowly £250 i said my bike was worth which will not get me another timely bike or will they get me a new bike?

They will pay out the bazaar value of your bike the day before the accident but not more than £250.
They will not get a bike - they pay out money and you can spend it all on mars bars if you like - you neediness never buy another bike if you do not want to.

Remember as well that if the bike is written off the insurance policy ends there and then and if you are paying monthly they will off the outstanding months from the £250. If you do get a new bike then you will then have to start a new policy

Motor Vehicle Insurance Claim Under Indian Law?

My POSSLQ = 'Person of the Opposite Sex Sharing Living Quarters' recently i.e., about 3 months, bought a TATA Indica 2005 model car move hand. He got the registration transfered into his his name but did not intimate the change of ownership to the Insurance company. Today the car that was kept under thached cote reduced to metal skeleton due to fire accident. My question is since the insurance policy as on today is still fixed in the name of previous owner... will non-intimation of change of ownership affect my friends unintentional of claiming insurance? are there any decided case laws on this aspect? Pls. Help with advices.
hi treasured Mr. unknown what you say is true only in case of third party liability not to own damages - in my friends if it should happen the company refused to cover damages for the non-compliance of intimation of change of ownership.

whoever holds the baptize of the car is the owner of the car. The insurance should be changed to the owner's name. Once a car is sold to another person insurance under the previous owner stops (even if they never make out their insurance company).

Vehicle Insurance Claim?

An uninsured myself ran a red light and hit my van that my husband and 2 kids were in. It has been considered totaled by the insurance company. Our uninsured motorist action has kicked in and we were able to get a rental car 4 days after the wreck this past Monday and now they are saying that we have to successively it back in on Saturday because they have determined a value on my van. The value they have come back with is not near enough to replace what I had. Also I had a dialect knoll that had a loose setting so i had put it in the ashtray of the van until i could get it fixed a few days prior to the accident and it could not be found. My adjuster just told me we would have to enter a claim with our homeowners for that. That makes no sense to me. We have never had to deal with anything like this but we have been getting a lot of advice from people significant us not to accept the first offer given to us. I'm just really upset about the whole ordeal and I'm rightful not sure what my legal rights are when it comes to dealing with an adjuster. We really are in dire privation of a vehicle at least until the first of the year. Is there anyway I can make to pay for a rental longer? Any advice on getting the most I can on my van? It was a 2002 fully stuffed Pontiac Montana. They only want to give us $7000 which doesn't come near to replacing it. The adjuster knows this but says they only have to give kelly crestfallen book value. Does anyone have any advice for us. It's much appreciated!!!!
The accident happened in North Carolina but we unexploded in South Carolina.
Well, at the time it was not a stupid thing to me. Our ashtray had never been used and it was locked up safe as houses and sound.
It just doesn't seem fair though, we paid them for 19+ years and then they go and low ball us on this claim. In my theory you should get enough to go out and replace your vehicle with the same thing. The accident was not even our fault.

The insurance companies agreement to provide you a rental car ends when they make an offer on your total loss vehicle. They are allowing you to keep the car a few days beyond the offering- that's more than they are legally required to give you. They are within their rights to make an offer and then tell you to turn the rental car in that day by 5.

As far as your Architecture goes......I don't have to tell you how incredibly stupid it was to put something that valuable in the ash tray. I'm assured you've told yourself that a few times.

They are correct. You have to report that to your homeowners insurance policy and your deductible will do.

Personal property in a vehicle is not covered under the auto policy. That stuff is covered by your homeowners programme.

Think of it this way.....if you took your van...turned it upside down and shook it.....if it falls out...it is not covered by the auto conduct. You would then have to file with your homeowners policy.

The insurance company does not owe you the replacement cost of your van. They owe the adequate market value of the specific vehicle that was damaged. As far as book values go...the industry sample is the NADA. You can look your vehicle up on their web site at: www.nadaguides.com.

How Long To Settle A Vehicle Insurance Claim In TX?

Someone crashed into my parked vehicle in June, and I talked to the other social gathering's insurance company within a day or two. It's now almost November and I'm still getting jerked around by the claims adjuster for the at-fault social gathering's insurance. He plays dirty, has gone behind my back several times, and just flat-out ignores me for months at a beat. I want to settle the claim and be done with him before I lose my temper. What are the Texas laws that cover this genre of situation?
@ken: Texas law requires liability insurance, including a minimum of $15,000 for damages to others' real estate. Unless I'm misunderstanding the basic point of insurance, that seems to me like they're under obligation to pay. ... I don't about it's the same in all states, though, which I don't understand. If insurance wasn't meant to cover the problems that you cause with an casualty, then why in the world is it required by law? (Rhetorical question ... I think.)
@oklatom: Wouldn't involving my insurance enterprise affect my rates, even if it wasn't my fault? I've never dealt with insurance before, so I don't know how badly they'll put the squeeze on someone you for no reason.

The other party immediately called the insurance company and told them everything (I wasn't haunt when it happened), and they called me to discuss settlement. They also sent me something in the mail a long period ago, so I guess they've accepted liability (I don't really know how they do that, so I can't say for sure).

I don't want to get into details over his behavior. Perchance that's SOP for car insurance companies (I hope not), but it ticks me off. And no, the adjuster has not yet looked at my vehicle ... he won't even tell me whether he's planning to, although I've asked multiple times. He always says that he'll get back to me, and then I lay out at least another month trying to get ahold of him again (two months the last time).

1st off, your car was parked when it was struck, so the other guy would be at to blame.

Better look for the letter you received from the other insurance company. This should be a clear case of to an extreme on the other guy, UNLESS he was not insured. The letter you received could have stated we are denying your claim since the other guy was not insured at the span of the accident, so if that is the case, they will not send out a adjuster to look at your car, since if they deny, there would be no reason to.

Call your insurance flock on Monday and report this accident. You will get stuck paying a deductible if you have collision coverage, but YOUR insurance assemblage will go after the other guys insurance for reimbursement of their payment and your deductible. If the other guy has no insurance, they will go after him personally.

YOUR insurance company can advise you of your options. You pay for insurance, let them do their job.

capable luck

Why I Need A Vehicle Insurance When Police Check For Vehicle Documents ?

Why I sine qua non a vehicle insurance when police check for vehicle documents, I know that Insured is to claim ur money in case of any price to ur vehicle but, I think its my whish that whether I want to get my vehicle insurance claim or not, than why Indian police claim fine if I don’t have Insurance paper after all its my whish whether I dearth or don’t want my vehicle to be insured.

Or, is it a document needed for police verification if yes than why?

If you own you vehicle manumitted and clear of the bank..you have to have liability insurance to cover damage you might do to someone else.
It is generally cheap.

If you owe simoleons to the bank for your car and the bank has your title, then the bank will require full insurance to protect their collateral ..your car.

The due to reasonable why is simple..before those laws were in effect, folks without insurance would ram someones car..hurting the driver and destroying their transportation then show up in court saying.
I am insolvent so too bad about your medical bills and your car...sue me all you want, I have not money to collect.

That is why most states (if not all) require at least hindrance insurance...to protect the other drivers from irresponsible drivers.

SMALL CLAIMS COURT Vs. VEHICLE INSURANCE CLAIM?

My $42,000 vehicle was keyed on 14DEC08 on a military introduction. Ever since the incident, I had been in contact with the court liaison. I specifically asked the court relationship if I needed to go to the arraignment of the suspect and if I needed to bring any estimates. He told me 'no' on at least 3 unalike occasions. The ex-wife of someone I just started dating pled guilty to the vandalism instil in FEB09. The judge ordered restitution based on an estimate that he received from the ex-mute of the suspect (who I no longer converse with). It is true that I did go to the establishment with him to get the estimate, but, when he gave me the think, he said he forgot to tell them about one of the scratches. Also, I told him that I felt the establishment was penurious and that I would not take me vehicle there to get fixed. So, he took the estimate to the court the day of her arraignment without my knowledge or permission. No one from the court (not even the prosecutor) got in reach with me to verify. The estimate that was given to the judge was $700.00. My estimates range from $1900.00 to $2700.00. I told the prosecutor and he said he was working on a change to modify restitution. A month later he told me they would not reopen the case because I agreed to the $700.00. He told me that I have to go to disconcerted claims court to get the rest. Also, the judge reduced the charge to Vandalism under $400 so it would not be a felony. What should I do? I discern I was screwed by the system and I am almost afraid to go to small claims court. I refuse to go through my insurance company. If I didn't recall who did it, I would have.
Homer...no one said an arraignment is a trial...If a person pleads guilty at arraignment there is no crack. Restitution is based on CRIMINAL....small claims is CIVIL....so you might insufficiency to take a criminal justice class because you sound really ignorant.
Homer, you are an idoit....indemnification comes from CRIMINAL not civil.....and if you are a lawyer, you need a new job...and I did get an answer from a authentic lawyer that works at the US Attorneys office and I can file in small claims......
In illegal law restitution is a regular feature in the sentences of criminal defendants. Restitution in the black hat arena refers to an affirmative performance by the defendant that
benefits either the victim of the offence or the general public. If a victim can be identified, a judge will order the defendant to devise restitution to the victim. For example, if a defendant is convicted of stealing a person's stereo, the defendant may be sentenced to repay the victim for the value of the stereo, in addition to punishment such as jail time and financial fines.

You might need a new dictionary too, Homer.
Res judicata only applies if I sued her once before....I have never been to court on this essentials. It was the state of CA vs. her. Not me vs. her. I don't have to go through my insurance company if I don't want to ......I will make sure to send you all my court documents when my cause is over. Maybe you can school someone else on it....you are pityful Homer....I really count you were lying about being a Lawyer.....cause I feel sorry for your clients......

Editorial: Dems ignore best way to cut auto insurance costs

Opinion piece: Dems ignore best way to cut auto insurance costs The Detroit News

Regal House and Senate Democrats proposed auto insurance reforms would likely desire all Michigan drivers to share in the very high cost of coverage now paid in urban areas, strikingly Detroit. They are not the best way to reduce insurance rates.

The plan would give state regulators more expert to control insurance premium rates and limit the criteria they can use for setting rates, which is expected to indicate up costs outside of major cities. This would penalize drivers who don't deserve it, but it wouldn't get at the biggest get determiner: Our no-fault system includes the richest medical benefits in the country.
